  5. The TRO is immediately appealable. The longer the State waits to appeal the more foolish they will look when they say they need the TRO lifted immediately.
  6. Got my permit in September About a week ago I got a letter from the Clerk of the Court saying that if there is a change in my status or residence or if I sell my gun I need to report it to the State Police and the Court and surrender my permit.

  8. The anti concealed carry bill passed the Senate on Monday. It will almost cerainlly become law soon. Be careful.
  9. A application for a TRO would only prevent the law from going into effect if the TRO is granted. It is highly likely that the Federal Judge who hears the application for a TRO will deny the TRO and allow the law to take effect. Do not hold your breath and assume the new law is the law as soon as it is passed and signed by the Governor.

The person handing out the approved permits at the Middlesex courthouse said to keep the original order with the permit while carrying even thought the order itself says to keep a copy of the order with the permit. So, according to the Judge’s written pronouncement a copy of the order is enough to keep with the permit while carrying, but if you got your permit from the Middlesex court is there any possible reason why you would want to get into a legal battle with a police officer, prosecutor, judge or jury on that issue? The order expires in two years anyways, so why not keep the original with the permit?

  16. ^^^I believe this is incorrect. If the law passes it can and will be enforced. The probability of a quick TRO exists but it is small. It is possible that none of it will by declared invalid by a court for many years. Remember, until a court with jurisdiction over New Jersey invalidates a part of the law that you want to disobey: Don’t do the crime if you can’t do the time.

  19. Just be sure to do it correctly. If you file an action and it fails you will be establishing bad precedent forever.
  20. In the “test” case now being litigated in upstate New York the first complaint was thrown out because the plaintiffs did not prove they were injured by the new laws. The second case held up, and got some very favorable results last week, because the same plaintiff swore that he would carry in the prohibited sensitive places but for the fact that the new law would make him a felon. but this was a carefully done up test case with experienced attorneys Do not try this on your own.
  21. You do not want to be a test case unless you do it correctly. For example, with the complaint for a test case you would swear out a declaration that you intend to carry more than the gun(s) listed on the permit. That way the case can go forward but you stay out of jail.
