  1. Funny, I have a CDL from a job I held over ten years ago and as such I am subject to being charged with a DUI if I blow ½ of the legal limit regardless of whether or not I am actually driving a commercial vehicle or working. Go figure.

Lets look at what we know... 1) SAF is filing federal law suits against the most restrictive carry states one at a time much as they did in the run up to McDonald: CA, IL, MD, NY, etc. 2) They are looking for cases strategically by district. 3) They have filed against individual county sheriffs in CA in District 9 4) They have filed against IL in District 7 5) They have filed against MD in District 4 6) They have filed against NY in District 2 When you compare the US District Court map with the 2011 "right-to-carry" map, what is left; District 1 and District 3... Obviously Massachusetts and New Jersey would be the most likely candidate states in those respective districts. The strategery would seem to be to shotgun the District Courts looking for conflicting decisions that could be run all the way up to the SCOTUS. They are turning the way liberals have used the courts for the last 40+ years in an organized effort to attack our liberties against them and I for one am happy as hell they are finally sticking it to them with their own process. The trick now is to get these cases up to the top before our Marxist in Chief can further corrupt the SCOTUS. All you need is one more Marxist on the bench to flip the 5-4 majority against the Constitution and we will be twisting in the wind for a decade. That said we also know the SAF has been soliciting potential candidate cases in NJ through the ANJRPC and NJCSD. I am sure with NJ being so openly hostile to gun rights they are crossing their Ts and dotting their Is. They could also be looking at multiple litigants in this state in either a combined complaint or separate individual complaints which would further delay filing. Either way I am shocked we have not already seen something filed and I can't imagine they would not file something before the end of the year... I have been somewhat ahead of the curve in calling this stuff for the last 10 years I have been paying attention to it, lets say I have had a better than good batting average in reading the tea leaves and if they do not file against NJ and or MA in at least the next 2-5 weeks I will be highly shocked. I am confident that NJ is going to get its a** handed to it in short order and am sort of surprised at the political hacks in Trenton content in their smug distain for gun rights that they do not see the tsunami coming.
  3. This may be the next or perhaps a second issue to attack but it is clear from the 4th and 2nd circuit cases that have already been filed what they intend to do. We are the most likely target for attack in the 3rd circuit given the climate we live with in this state. NJ has so many things wrong with its gun laws and the way it persecutes gun owners, every gun rights group could pick a different issue to attack and we would still find things we were not happy with. You will see some movement sooner than you think... Sit tight grasshopper, go buy a big bag of popcorn and get ready for the show.
  4. I don't think we know that. AFAIK, there has been no major court case on "re-clarifying the clarification" and re-interpretation of firearms laws. A class action is the only way to see what happens in NJ courts. A place to start would be to identify 2A supporting gun-owning judges and file motion there, make a big stink in the news media ... go from there. Wow, how old are you guys? The Colt Match Target/Springfield M1A AG Directive from March 31, 1997 and the AG guidelines issued August 19, 1996, regarding the “substantially identical” provision of the assault weapons law were a direct result of the Coalition for New Jersey Sportsmen, Springfield Armory and Colt Manufacturing suing the state over the language in the law. Specifically pinning them down on what "substantially identical" meant. The judge in the case asked the AG to give his interpretation and that is what we got. They grasped for every straw they could but the "banned as a type" crap was a rather poorly researched stretch to protect as much of the law as they could... They did manage to get the language in the bill that attempted to give the AG the ability to update the list of weaspons annually in the law... Could you imagine?

M14 S Type: M1A (Post-Ban) FN FALs are banned as types yet DSA SA-58s are legal Armalite AR-180 is banned as a type yet the Armalite AR-180B is legal The G3SA is banned as a type yet it is a semi-auto G3 clone (an HK-91) and HK-91 clones are legal SIG 550SP, SIG 551SP are banned as types yet Sig 556 is legal Yet they cry about the Uzi and the M1 Carbine (9mm or .30cal carbine "type" gun evil yet .223 and .308 "type" guns good) WTF? These idiots would be unemployable if they didn't work for the govenment...
  7. The only problem with that is they can charge you for the sale that they have documented took place in the state of NJ... Consider the 24hrs a grace period to annul the transaction before they decide to prosecute you... You might be able to work something out with the FFL to ship it to a PA FFL where you could pick it up there. That would negate the NJ transaction and as long as you didn't bring the gun back into the state they can go pound salt...
  8. As long as the gun still has the fixed 10 round magazine he is good in NJ. If the gun has been converted to detachable magazines or has had the fixed mag replaced with one of the Norinco 20 round fixed mags its not legal in NJ. Yet another example of NJ's finest not knowing the laws they are tasked with enforcing...
  9. I was not a big Christie fan from the start, I knew about his AWB flyer when he was running for assemblyman or some other position. I had a gut feeling he would be another Whitmanesqe RINO. I wanted someone to go to Trenton like a drunken Brazilian sugar cane farmer heading off to the fields with a sharp machete after getting pissed-off in a fight with his wife... What we seem to have is a supersized male version of Christie Whitman content with paying lip service to conservatives in an attempt to get their votes. If he and his libtard AG keep this crap up and I wouldn't vote for him again if he was running against Lautenberg. I'd rather have a libtard with a D after his name that I didn't vote for start sticking it to me than one with an R after his name resume sticking it to me.
  10. One glaring issue with that NO ONE CHANGED THE LAW! They simply decided to reinterpret it, kinda like that whole "living Constitution" thing where you get to make **** up on the fly to fit the particular argument you are trying to make. That is BS. Sort of like trying to pretend in 2006 that there were 10 round Glock 17 magazines in 1990 when the State Police back then told everyone that they were legal if they were blocked to hold no more than 15 rounds at the time of inspection... BTW, the MAK-90 was advertised as "an approved version of the famous AK rifle". So who are these douchebags today making things up as they go?
  11. The MAK-90 has been legal for 15 years without any BS. The gun is stamped "Norinco MAK-90" which stands for "Modified Automatov Kalashnikov 1990". The gun was modified to meet the sporting purpose requirements imposed on imports by the George H. W. Bush administration in 1989. At least the guns in question here don't even have "AK" stamped on them...

With literally millions of M1 carbines and semi-auto AKs in the hands of average law abiding citizens throughout the US an argument can be made that these weapons are "in common use", protected under the second amendment and can not be banned.

So the crux of the matter then is they are again arguing that a weapon is not illegal predicated upon the essential nature, naming convention or even the usual cosmetic features of the weapon itself per se but upon the marketing and respective literature propagated by the manufacturer... Funny I do not seem to recall seeing that criteria in the NJ assault weapon ban's "substantially identical" clarification issued by the state AG back in 1996... I said it months ago when they pulled this BS on the AO M1, somebody with standing better sue them to put them in their place or they are just going to keep pulling this crap over and over... Even Corzine's gaggle of nimrods wasn't this absurd. With literally millions of M1 carbines and semi-auto AKs in the hands of average law abiding citizens throughout the US an argument can be made that these weapons are "in common use", protected under the second amendment and can not be banned. I would further suggest we as a voting block start taking note of Paula Dowd's positions and actions on our issues and we begin to put some pressure on Christie to let him know if she does not go or at least cut the BS out we will not be supporting or voting for him next time around. I know he is fond of saying he does not care if he is a one term Governor but his aspirations are higher and unless he starts getting it right on this issue soon he is cooked if he thinks he can get elected in a national election... At least that's my 2½¢
  14. Looking at the bottom of the gas block it sure as hell looks like that thing will accept a bayonet... Most of the "post-ban" guns had the bottom of the Polish/Russian/Romanian stlye blocks rounded off so you could not mount a bayonet. It was easy to figure out if a gun was NJ compliant before the sunset of the federal AWB but now since it has expired you need to be seriously careful that the gun you are looking to purchase is indeed "post-ban" compliant. Even some of the ARs out there today, the brakes look just like a danmed flash suppressor. Regardlesss though, look at the part number... "AK470405" That is a problem. And nothing on their web site indicates that they offer any type of "pre-ban" vs. "post-ban" configurations to meet state laws other than the specific California guns... Could be specific to this group of weapons from this manufacturer but this will only draw fire on the other guns that have been legal in the state for the last 14 years or so...

After the whole S&W "SW99NJ" debockle I have a strong memory of them switching to the Sig P226/.40S&W because I remember thinking it was silly to not go with the P229 considering the mag capacities were the same and the P229 was more compact having been designed around the .40S&W round however I can't find any archives confirming this... I work with two retired troopers, I have to ask them in the AM what they switched to back in 2001...
  16. There are several things going on at the same time. If I was a betting man I would say you will start to see them surface in the next 5 weeks or so before Christmas. Heller II stands a very good chance at putting a fairly large dent in the core rational behind any of the AWBs. The road map to overturning the AWBs, hi-cap bans and even class 3 bans is there already. You just need a skillful litigator and at least a 5-4 majority on the SCOTUS to be open minded enough to follow the logic and facts without letting hysterical emotions cloud their thought processes...
  17. Don't hold your breath for the most part... The NJ legislature is going to hold out until the federal courts gut the state gun laws. They are arrogant and smug as they consider themselves to hold the high ground on guns. They are ignorant and tone deaf to what is happening all around them and will inevitably scramble when the feds strike down their precious laws to enact some form of brazen legislation in a vein attempt to hold onto their ideological gun free utopian dream. NJ's gun laws will fall and will fall hard but you can bank on the legislature fighting for every scrap of tyrannical control they can retain... All we can hope for is to be freed by an external force (Federal law suit) because the state politics leans too far left to get anywhere on the issue.

  21. I wonder if they actually tested the gun or just assumed it was a machine gun because it was belt-fed... Gun was most likely an MG-08 (WWI German copy of a Maxim) there were a number of these guns sold as parts kits years ago without the side plates (actual part of the gun that mounted the full-auto parts). While there are numerous semi-auto Maxim varients out there and non-firing MG-08 display guns, I have never seen a semi-auto MG-08.

They didn't clearify models but there are pre-ban (pre '89 - rare/expensive), post-ban (post '89 thumb-hole stle) and post-ban (post '98 922r compliant) versions of the Hungarian FEGs (SA-85M), the Chinese Norinco (MAK-90) and the Romanian (ROMAKs, WASRs and SARs) AKs. If the Norinco was a MAK-90 it is legal in NJ as long as it was unmodified. Most of the FEGs I have seen are post-ban thumb-hole stock guns and 99% of the Romanian AKs are post ban. Don't forget the import restrictions predate even NJ's ban compliments of George H. W. Bush in '89 and remain in effect even today... In order to have the Hungarian or Romanian AK in a pre-ban configuration you need to intentionally replace a number of parts to make them 922r compliant... Chances are slim these guns were really assault weapons... That said the guy is an idiot that needs to go away, glad he pled.
