Yea, thats what I said. But it has nothing to do with "Prepared" it has everything to do with procedure.

The prosecutor will not be prepared to try your case on your first appearance. I doubt you would be able to obtain your discovery by then anyway. The judge will only read off your charges and accept your not guilty plea and advise you to seek legal council. Kind of a waste of your time. First Appearance isnt FOR trial it's what would be considered an "arraignment" in a more serious case. first Appearance is just for you to formally Plead Guilty or Not Guilty. MOST courts want you to call several days before the Appearance date if you are pleading Not Guilty. Yea, thats what I said.

I believe that every department has MVRs nowadays. Talk to the Records Bureau of the PD who issued the ticket and get a copy of the MVR footage for your stop. You can then present that in court. I doubt the prosecution would be willing to provide you with anything you could use in your defense. They do have to provide you with what they intend to use against you though, upon your request.

Go to your first court date and plead not guilty, or call the clerk and see if they will accept your not guilty plea over the phone and schedule your trial date. Also, while on the phone with the clerk, find out what that courts procedure is for obtaining the discovery in your case. The discovery is what the state intends to use to prosecute you. You have a right to this information. It will most likely cost you a few bucks for copies and mailing. If the officer didn't see you speeding as you say, the state will not have any evidence against you except his word. At this point a good driving record works in your favor in front of the judge. I never go to the movies, I'm too cheap to have HBO or rent or buy it on CD. I wait until movies come out on channel nine. Usually takes about 3-4 years before I see a new release. Channel nine rules, they play a lot of spookey stuff.
