  5. I'm skeptical of pro 2A democrats, but Democrats in NJ outnumber Republicans. Gun rights needs to be a bipartisan issue for it to survive in NJ.

  10. I believe NH accepts permits with restrictions. So if you have, say, a security guard permit, you can get a NH non-res LTC.
  11. Either way, it's a regulation written by the agency and not a statute. It can be changed without the legislature.

  14. I never said it was just a wave of hand. But the AG has the power to change it. The regulatory method is here: http://www.state.nj.us/education/code/process.htm Yes, there may be public comments but this stands a much better chance than getting something through the legislature in its current form. It's not like the public comments are binding anyway. Look at the MVC's rules on Tesla and car dealerships. Lots of outcry about that one but in the end the rules were adopted.
  15. Understand that if they do that they enter very very dangerous territory. Especially if a higher court or a federal court smacks them down.

  17. That doesn't matter. They have to follow the law. If the law says that "self defense" is sufficient justifiable need then they have to abide by it. And if all judges agreed then there would be no need for appellate courts, nor the Supreme Court. Justifiable need is in the administrative code which is written by state agencies and published in the New Jersey register. In this case, it is the Attorney General who wrote the rule for justifiable need, based on the practices of police chiefs (which was part of the Siccardi decision).
  18. You're saying the judge will ignore the AG? I think some of them will try, but a lawsuit will be the result.
  19. That could change if they have enough reason. Nikki Haley is strongly pro gun. We should all ask her if she would be open to getting that policy changed.
  20. Kane is acting entirely on her own, or at least she seems to be. She might be getting off the record direction from gun control groups. Bloomberg got her elected. This was a campaign promise, to close the "Florida loophole." However, Kane couldn't just arbitrarily drop recognition from what I understand. She had to determine if there was a change in the law that would trigger review of the recognition. As for our AG, absolutely. Our AG can accept "self defense" as justifiable need. The whole definition of justifiable need is what Nappen refers to as "judge made law" which basically means that it is whole cloth from case law, specifically Siccardi and Sills. These cases formed justifiable need based on the policies of police chiefs. Justifiable need? NJSP and the AG made it all up. It's the same deal in California except that the sheriffs get to decide what is "good cause" and not the AG.
  21. LOL, so I guess I will be the first to bring up the fact that Anthony is pro 2A and one of the select few with a NYC red card (unrestricted carry license.) It almost seems like SXM wanted to get rid of them and not renew them anyway. Anthony has said far worse than this incident. BTW, the attitude of people in the city is getting worse by the day. This along with the rising crime is probably going to drive me OUT. Only bad thing is NJ's economy sucks hard. I miss when I used to work in NJ.
