old gun

In the late 70's someone I know lived in NYC.

He bought a .22 rifle and registered it in NYC.

He moved to NJ over 20 years ago.

Rifle was given to someone else in NY State for safe keeping.

Since the person did not need the rifle and did not want to be

bothered with getting a FID card. Don't even know if that was

necessary years ago.

 

A few years ago the original owner bought a seasonal home in NY State.

The rifle was brought over to the NY State house by the person that held it for 20 years.

Now the original owner wants to bring the rifle to NJ.

He has a NJ FID card.

Since the rifle was his 20 years ago and never really transferred to anyone

else can he just bring it back into his possession

or does he have to buy it back, in effect from himself since the person

that had it for 20 years is no longer alive?

 

While we are on the subject.

Do you have to have papers all the rifles in your possession?

If the rifle was purchased legally in another state, he needs to do nothing to bring it into NJ, as a NJ resident. He doesn't even need the FPID.

 

It was 100% legal but at this point there is no documentation.

Since this was about 25 years ago.

I guess he's just being paranoid.

That is the problem with being honest and law abiding.

It you are a criminal you just show them the money and get it the same day.

It's still 100% legal. I don't have documentation on any of the guns that I got in Ohio. I had them long before I had a firearms purchaser ID and years before I moved to NJ. They're still legal.

 

If he does not have a purchaser ID, he needs to make sure he follows all the transport laws. Take the gun home, enjoy it, take it to the range, whatever. It's completely legal.

A few things to remember:

 

Make sure it's not going to considered an "Assault Weapon" - if it's semi auto, it can't have a fixed mag capacity over 15 rounds.

 

NJ does not register long guns, so there is no paperwork need to bring it over from NY if purchased legally there.

 

A "Certificate of Eligibility" is required to be filled out at the time of a long gun purchase when sold in NJ, it is a good idea to save this form but I am not aware of a legal requirement to do so.

 

Guns bought when living out of state, acquired before 1966 or inherited will not necessarily have paperwork and can still be owned legally.

Probably the most likely guns to unknowingly break the "assault weapons" ban with are older Marlin Model 60s. I believe ones made before the 1980s have a 17 or 18 round tube magazine which makes them illegal in New Jersey. Later, and I believe in direct response to the NJ ban, they started making them with a slightly shorter barrel and and a 15 round magazine. This is a .22 caliber rifle that looks very "harmless" compared to AK-47s and M16s, but it is no less illegal. I just wanted to mention this since the Model 60 is an extremely common gun, and the timeframe you are talking about makes it possible for him to have one of the older high capacity versions.
