Maryland Firearm Groups Sue

Hopefully either here in the District Court, or eventually in the SCOTUS, we can get a positive ruling on firearms in common use.

Maryland: Multiple Citizen Groups Unite to Prevent Senate Bill 281 from Being Implemented with NRA’s Support

 

 

Yesterday, with support from the National Rifle Association the Associated Gun Clubs of Baltimore, Maryland Licensed Firearms Dealers Association, Maryland Shall Issue, Maryland State Rifle and Pistol Association, National Shooting Sports Foundation and several firearms dealers along with individual Maryland citizens, filed suit to stop the implementation and enforcement of Maryland’s planned ban on certain common and popular semi-automatic long guns and restriction on the purchase or sale of magazines with a capacity in excess of ten rounds.

 

The Maryland Firearm Safety Act of 2013, alternatively known as SB 281 (the “Act”), will ban the purchase, transportation or receipt of any of the listed semi-automatic firearms after October 1, 2013.  Additionally, the Act will ban the purchase or sale in the state of Maryland of any detachable magazine for either rifles or pistols that holds in excess of ten rounds after October 1, 2013.

 

This lawsuit, filed yesterday in the United States District Court for the District of Maryland, requests immediate emergency injunctive relief in the form of a Temporary Restraining Order because the Act is an unconstitutional violation of the Second Amendment right of the law-abiding, responsible citizens of Maryland to choose effective firearms for defense in the home.

 

While the NRA is not a named party to this lawsuit, we are supporting the citizens of Maryland in this, and all future, defenses of their Second Amendment rights in every way we can.  Your NRA-ILA will continue to keep you updated when more information becomes available.

On a related note I travel through Maryland quite often with work....and there are a couple outdoor ranges that some Delaware friends liked to go which I'd stop off at to shoot with them....but with the signing of sb281 they were trying to figure out the effect on them as out of state residents traveling to md ranges/shooting events....they called the offices and left half a dozen messages to no avail..no call backs so I spoke with several msp and town Leos and none seem to be on the same page....got everything from "don't worry about it..nothing's changed for them"... To " tell them to stay out ..they would be arrested and charged with felony possession"...... I spoke with a sgt in the licensing/enforcement office....who agreed that there is no provision/mention of non residents and they would "probably fall under incoming new resident/or grandfather clause and "should" be ok but no guarantee"... Hard to believe there's a more clusterf***k state than nj....lol
