  1. SCOTUS HEARS CRIES OF MOOTNESS IN NYSR&P CASE! UNDETERRED, TRUTH TRAIN STILL BARRELS DOWN TRACKS! by Theresa Inacker, CNJFO Communications Director 12-02-19 www.cnjfo.com/join-us Keep Calm and Litigate On! The day for oral arguments finally arrived, as attorneys appeared before the Supreme Court of the United States (SCOTUS) in Washington, D.C. to argue disputed matters in New York State Rifle & Pistol Association v. New York City. At the heart of the matter, it is a challenge to New York City’s firearm transport ban. Both sides—Pro-Second Amendment folks and anti-rights groups like Big Daddy Bloomberg-funded Everytown, Moms Demand and the Brady folks alike, anxiously awaited a long-overdue conversation on the substance of the Second Amendment’s application outside the home. Disappointing to some, the Court focused on the issue of mootness more than the merits of the Second Amendment’s application outside the home. The issue of mootness seems so academic and theoretical: Well, it is exactly that. Unlike a right to Keep and Bear arms which is tangible and substantive, mootness isn’t very interesting. You may be asking what is mootness? A case is moot “when the issues presented are no longer alive or the parties lack a legally cognizable interest in the outcome of the lawsuit.” See www.FedBar.Org March/April 2008. Not very exciting, but extremely critical to American jurisprudence. Left-leaning media are enthusiastically pushing their articles about how the Court does not seem interested in expanding Second Amendment rights after today’s arguments. They think they’ve found an off-ramp for this 2A train barreling down the tracks. I tell them, do not count your chickens before they’ve hatched. If this train car doesn’t get heard on the merits, the Cheeseman case will, or another thereafter. My pro-Second Amendment folks: do not lose heart. No one knows how the Court will rule. No one knows why a Justice asks a question or remains silent during oral argument. Justice Clarence Thomas asked his first question in three years back in March of 2019 ---that was after ten years of not asking any questions, from 2006 to 2016.   4. A live Turkey Shoot where just the heads of the fowl are exposed to gunfire? Or a paper Turkey Shoot where you pay $2 per square on a sheet of office paper w/ 36 squares on it, with each square having an "X" thru it and the closest pellet to the center (out of the 36 "X"'s) of each sheet shot with birdshot is the winner? I've run dozens of paper Turkey Shoots in my lifetime, mostly for our local Boy Scout Troop. Rosey

I'll be in the area on Saturday the 25th for frolicking at the winery tasting & the historical restaurant before hittin' the sack at a B&B in Mount joy, PA (about 15 min. from the boat ramp). Rooms are still available & the breakfast can't be beat! Wear yer sidearm at the dinning room table!
  6. Going to Daughter in-laws' Grandmother's house in Kinnelon. A tradition since since the kids were dating in college. Tonight is the 5th Anniversary of the Engagement Proposal (they're married 3 years this last October) that took place at Grandma's T-Day Dinner. Granny is 80+ , has a 3-4 BR bi-level complete w/ wood-burnin' fireplace (which she still uses) and accepts kitchen help as long as things ARE DONE HER WAY & SHE'S IN TOTAL CONTROL My NRA Life Member & Muzzleloading Expert Son, now 30, carves the gloriously-basted Bird. Been his "job" for years now. 3 years ago Granny nosed-around once too often as he was carvin' the Bird, so he defensively claimed, "I'M WORKIN' HERE"! Probably just a lil' nervous since he was gonna "pop the question" at dessert! All was forgiven when the "the rock" came out of hiding So every Thanksgiving we all gather'-round the kitchen (where the apps are served) and exclaim, "I'M WORKIN' HERE!" I was a professional Photog & did weddings & portraits (now retired & doing private teaching, when asked). Theirs was the last Engagement Session I did. Here's a pic of their session done at the Horse Farm she rides at & a pic of an Easter ham he cooked at our place. I sent him to "summer cooking school" for 2 consecutive summers when I had my studio (years ago), as the 4-Star upscale restaurant gave classes, which I bartered for commercial photography for the owners' website. Besides the Bird, stuffing, my wife's famous string bean casserole (she makes it every year---it's automatic at this point), mashing taters, yams, and home made gravy & rolls, there's too many desserts to mention! Diabetic Coma for us all! Adult beverages & of course fresh ground coffee! May you all have a wonderful Thanksgiving & remember both commercial ranges & private gun clubs are OPEN TOMORROW! In fact Old Bridge's Shotgun League is doing a 50 bird Sporting Clays for $20 American (and the PUBLIC IS INVITED!), SO GET YOUR FAMILY & GUESTS OUT TO SHOOT! HAPPY THANKSGIVING TO ALL! Yes, the spouse without papers has to go get P2P's for every hand gun as well as a NJFPID for long guns and YES such a hand gun transfer qualifies for an OGAM exemption as if you were inheriting an estate. Generally all tangible property is assigned a dollar value at divorce. So whomever owns the guns and still wants to own them would have to pay approx. 50% of the guns net asset value. If you don't want that pretty pink stocked .308 or the pretty turquoise Glock you gave your partner, you could sell those, give the partner half the proceeds and use the other half of the money to buy-back the rest of your collection YOU ALREADY OWN
  14. I bring this type of transfer up quite often as I lecture. It's interesting to note that you can't take possession of a hand gun w/o papers unless it's willed to you. But if the party that named you in the will is still ALIVE, the act of the identical transfer is a FELONY to BOTH PARTIES! Further, married couples can't "borrow" each others' hand guns to go to the range to practice, even though this personal property would be evenly split in a divorce situation and/or all go to the surviving spouse in the event of a partners' death. ASININE gun laws! ~R

  17. Not that I'm aware of as of last Friday. This of course could change at a moment's notice. I was originally led to believe he WAS since that's the basis of his original Facebook post... I will say that I wrote the original story and then asked Mr. Harkin to proofread it for errors, which he did. On the 25th it was GTG. Subsequently, the timeline was corrected. I didn't alter the original story because I have to maintain integrity. I reported what was said to me, and the subject of the story proofread it for errors.
  18. Doug, Just hit me up on a PM for a phone call so I can explain what's going on. I can't publish EVERYTHING Here's a tidbit: The Marine's family lawyer was sent an email on 10-22-19 stating that the Sgt. on scene during the search & seizure in February was set to testify on Nov. 15th, IN ADDITION TO an Expert witness on the identification of the (2) 30-round mags. So a chain of evidence testimony along with an Expert saying the mags are illegal... So what's to stop the Bergen Co. Prosecutor from stopping the proceeding right then & there and placing Mike under arrest for the mags? Why email a witness list to a defense attorney if everything was hunky-dory? His initial arrest was for alleged DV back in February. That's when he didn't comply with the search. That's when the mags were found in the footlocker. That's the error in the timeline in the original story that the Marine didn't tell me about. The TRO was dropped when 50% custody was awarded to his Ex-Wife. The 8 year old is a heart transplant survivor. I interviewed Harkin for almost an hour. He read the story & approved it. Harkin went public the day after his family attorney got the email about the witness list. That was 10-23. I interviewed him 2 full days later on the 25th. Waldwick is in "Damage Control" mode. Harkin is very upset & nervous, and although he mixed-up the timeline during the interview a little bit (he was arrested in February, not September), he's still a victim of NJ's gun laws. They still have his shotgun. And he's still going thru the NJ meat grinder. I can only publish what was told to me. If I was the Asbury Park Press I could have slanted the entire story, called the mags acc's for an Assault Weapon, and gotten more than 50% of the story wrong
