USERRA goes to the supreme Court

Its about time. Way too many of my comrades get screwed after they deploy and have no idea what to do with it or how to fight it.

 

USERRA is the congressional act that holds a deployed soldier's job for them when they are mobilized/deployed.

Now a USERRA case involving a reservist who claims he was fired because of his military service is slated to be decided by the U.S. Supreme Court. Army Reserve Sgt. Vincent Staub sued his former employer, Proctor Hospital of Peoria, Ill., in 2004 after being fired from his job. He claims he was let go after fellow employees, bitter or resentful over his taking time off for military service, conspired to damage his job performance. Staub won in district court in Illinois but had the verdict overturned by the 7th Circuit Court of Appeals in March 2009.

 

WTF? Bitter or resentful because he went to serve his country? He didn't take time off for a vacation. What is wrong with these people?

That is only part of the story of what is happening all around the country. At least 17 of the 170 guys I deployed with got screwed out of their job by some loophole or plain old BS. The favorite thing for an employer to do is change the job title and claim that the position was elimnated.

 

Depending on how much effort they put into the manipulation, it can usually work.
