The thing is, I don't think anyone would think about that situation, and then if no one noted how much ammo was in the magazine or something....I feel like it would be very hard for that situation to arise in a way in which people could actually have the evidence needed to bring a case forward.

 

Besides, a state's lawyer could always say "Well, there's no guarantee that one bullet would have hit, or stopped the assailant."

 

Besides, that's why you gotta practice your tactical reloads dawg.
