NJ AOW

I have created a NFA trust to avoid the prints, local police chief sign off, etc. to buy a nice AOW.

 

I remember Evan Nappen mentioning the "Auto Burglar" is NJ legal, actually one of the only NFA AOW weapons we can own here.

 

So....

 

With NFA trust paperwork in hand I need a pistol permit for NJ transfer and the $5 ATF tax stamp. Everything is legal but I need to find a FFL willing to transfer this.

 

 

Open to comments...I know I'm crazy for trying this but Nappen had said it was legal with NJ P2P and ATF $5 stamp.

Here is the firearm in question, it's 20ga and was manufactured as a pistol by Ithaca.

Too bad the center fire version is illegal!

 

Now if you want the black powder double-barrel muzzleloading version of this, entitled "Pedersoli Howdah Hunter 20 ga. Pistol", well, Cabela's has 'em on sale and you can walk-in with seven dead presidents (plus 6% PA tax) and walk-out with it cash and carry, lol........because since it's black powder the Feds don't even consider it a gun!

Under what part of the law are AOWs actually banned? I've never seen something than bans all of them. AOWs come in all shapes and sizes. I've been asking about this for years and people just laugh, never tell me what the joke is.

New Jersey NFA Class 3 firearms

There are several type of Class 3 items that are restricted by the National Firearms Act.

 

Each state can impose additional restrictions on the sale, purchase, and transfer of class 3 firearms in addition to the compliance that is required with the national Firearms Act.

 

In New Jersey you can own the following items that are regulated the the National Firearms Act

Machine Guns *

Any Other Weapon (AOW)

In New Jersey you cannot own the following NFA restricted items.

Silencers Short Barreled Shotguns (SBS)

Short Barreled Rifles (SBR)

Destructive Devices (DD)

I am going to go out on a limb here.. I do NOT think that it qualifies as a sawed off shotgun.. they may want it to be.. but per their own words.. not so much..

 

 

 

n. "Shotgun" means any firearm designed to be fired from the shoulder and using the energy of the explosive in a fixed shotgun shell to fire through a smooth bore either a number of ball shots or a single projectile for each pull of the trigger, or any firearm designed to be fired from the shoulder which does not fire fixed ammunition.

o. "Sawed-off shotgun" means any shotgun having a barrel or barrels of less than 18 inches in length measured from the breech to the muzzle, or a rifle having a barrel or barrels of less than 16 inches in length measured from the breech to the muzzle, or any firearm made from a rifle or a shotgun, whether by alteration, or otherwise, if such firearm as modified has an overall length of less than 26 inches.

 

to be a sawed off shotgun it has to start as a shotgun..

under NJ law to be a shotgun it has to start its life as something shoulder fired... so by NJ definition.. this is NOT a shotgun.. thus can not be a sawed off shotgun..

 

"any other weapon" or "AOW" does not appear to return any relevant results within the actual law..

Initially this is how I interpreted the law.

 

I found a neat MAC stinger pen gun for sale, it's Federal status is AOW so $5 stamp which is no problem.

 

I can get a P2P for it from the local PD, no problem.

 

I have a NFA trust I did myself to avoid the Chief Law Enforcement Officer signoff, again no problem.

 

BUT! Who handles Class 3 transfers in NJ? I thought regular 01 FFL's could do a few every year without the additional SOT tax so....

 

Any recommendations on NFA friendly FFL's? I would chop off my lower digit for one (no, just kidding) but REALLY want one.

FFLs must pay the SOT to transfer in NFA with a Form 3.
