This legislation is 100% driven by the restaurant and bar lobby. They see microbrews cutting into their turf without the pound of flesh the state requires for a liquor license. I can somewhat see their point though. At some point a microbrewery is a restaurant and should get a license. At the same time, fuck the political and lobbying BS. These places should be allowed to have seating and team with other restaurants, delivery, etc. Serving cocktails or another (commercial) beer makes you a bar though.

I’m not sure the constitutional strategy for NR. I think it would be a stretch legally. Also given the recent state’s scope aspect of the recent scotus decisions I'm not sure it would be successful.

He’s certainly trying to. Yes. It means new lawsuits to challenge the new rules. They don’t go directly to scotus though. Start with the lower courts first. In theory those courts should use Bruen as a guide and nuke them there. In theory.

Killing Intermediate and even Strict Scrutiny will do that. More importantly the NJ mag ban sitting at scotus could get resolved as early as Monday if they remand it back to the 3rd or better summary rule based on Bruen.

If I remember right there were quite a few cases held either at Scotus or circuit courts waiting on the result from Bruen. One was the NJ mag challenge and I think an AWB (MD?). Also the CA mag, ammo, and AWB are there somewhere. Since those cases are already at a high level they should quickly get sent back to be redecided with the new precedent. We shouldn’t have to wait for a new case to make its way up.
