Genewarper111 18 Posted March 21, 2010 Hi A repost here from a thread started in another place http://www.njcsd.org/forum/showthread.php?t=3747 but one I thought people would be interested in. It describes the follow-up case to Heller, where the Plaintiffs are arguing on the basis of Heller and other decisions, that the individual has the right to carry a firearm for self defense outside of their home, in the District of Columbia. As pointed out by the original poster, the Plaintiff's argument is really interesting and well worth a read. Best G [edited for spelling - Sun Mar 21, 2010] Palmer is a good case..just remember that any case that involved DC DOES NOT APPLY outside of DC or otehr Federal areas.... That's why the rest of the Country had to wait for McDonald even though SCOTUS deemed in Heller that the 2nd was an individual right, not a collective one. EngineerJet 191 Posted March 21, 2010 Correct me if I am wrong. But my understanding of it was, if they rule that the second amendment garuntees the right to carry a firearm, and mcdonald is suppose to incorporate the second amendment to the states, wouldn't mcdonald automatically default carrying to the states as well? DirtyDigz 1,812 Posted March 21, 2010 Oh well, so much for that. Tried to register for the NJCSD forum using the same username and email I use for this forum. After I confirmed the registration email and logged in for the first time, I got: You have been banned for the following reason:No reason was specified. Date the ban will be lifted: Never WTF!? No, because McDonald has NOTHING to do with carrying. McDonald is fighting a complete handgun ban in the Chity of Chicago that was very similar to that in DC. EngineerJet 191 Posted March 22, 2010 Yes the Mcdonald case is about the handgun ban, but the result is incorporation of the second amendment. So if Gura was able to argue that the second amendment garuntees the right to bear, and Mcdonald incorporates the second against the states... see where im goin with this? It doesnt make sense to me that IF they ruled bearing arms as a right, they would say "The second amendment garuntees the right to bear, but only at the Federal level, even though we ruled that the second amendment is incorporated against the states". Thats just how I see it.

At my other forums, we occasionally get board spammer(automated computer forum spam) signups so we turn on auto ban upon reg completion. We leave a nice note however and tell folks that a human will look over their registration and approve if everything is A-ok. It usually takes an update to the Recaptcha human filter then we go back to normal signup. That said, if I saw DirtyDigz...I'd just figure you were a porno spammer. Shrug, I'd ban you too.
