Police: Backyard shooting session in Springfield leads to SWAT team response

By Tom Wright-Piersanti/The Star-LedgerThe Star-Ledger

SPRINGFIELD — A backyard shooting session Tuesday night led to a full response from the Union County SWAT team and the arrest of two men on various charges, authorities said this evening.

Timothy Penna, 42, of Springfield, and Matthew McDarby, 44, of Bridgewater, were arrested after they fired about 15 rounds from a .45 semiautomatic handgun off Penna’s deck at various objects in the backyard, including a metal birdfeeder, said Lt. Judd Levenson, a spokesman for the Springfield Police Department.

A woman and a 4-year-old child were inside Penna’s home when the men were arrested, Levenson said, though they were not there when the men allegedly shot up the backyard.

Police responding to reports of gunshots at around 11:30 p.m. Tuesday found McDarby on the deck of Penna’s Tooker Place home. McDarby ran inside the

house after police noticed shell casings, Levenson said.

When the police cruiser’s public address system failed to bring the men out of the house, Springfield Chief John Cook called in the Union County SWAT Team, Levenson said.

A man who identified himself as Penna’s father intervened, and successfully talked his son out of his house, police said. But McDarby remained inside despite numerous attempts to get him to come out, Levenson said.

Authorities said the SWAT team entered the home and found McDarby in the basement, where he was arrested.

“Consumption of alcoholic beverages had to do a lot with what transpired,” Levenson said. He said local residents were never in jeopardy.

Additional investigation found that McDarby accidentally discharged a gun in the kitchen after the men had fired off the deck, Levenson said.

Police recovered three .45 semiautomatic handguns, all legally purchased and registered.

Penna was charged with one count of maintaining a public nuisance creating a dangerous condition, one count of disorderly conduct, and two township ordinance violations relating to firing of firearms within Springfield.

McDarby was charged with one count of obstruction of justice and one disorderly conduct. He also received the township violations.

The men will make their first appearance in municipal court on April 22.

    • I like my regular carry holster.  OWB leather with belt slots.  I've been carrying for over a year and it was comfortable and I hardly even noticed it.  I carry (usually) a Ruger LCP .380 - light, convenient, tiny. But...today I ended up taking it off an leaving it home after a few hours. I cut down a big maple tree a few days ago and I spent 3/4 of today loading and unloading firewood into the back of my truck and a trailer.  It was a warm day, I was dirty, tired, sweaty, and my holster was rubbing against my side.  The leather and exposed metal snap was no longer comfortable. I'm thinking about adding a layer of something to that part of the holster to soften the contact.  Anything insulating will make it worse.  I don't want a sweaty, hotter holster against my skin.  I'm imagining something thin, breathable, that won't absorb sweat, and softer than leather, metal snaps, and rivets.   But I have no idea what would work. I'm hoping somebody else has already figured this out and I can just do what they did. Any suggestions appreciated.
    • Check the primers on the ammo you didn't shoot yet. Are they fully seated? If the primer is not just below flush with the back of the case, the first hit can seat it better then the second hit ignites it.
