Could Someone Lead me to the Federal Statute

Could Someone Lead me to the Federal Statute that allows me to transport a handgun on an airplane through a NY airport. I will be leaving and arriving from a NY airport to Georgia want to bring a handgun with me. Of course, all transportation laws will be followed.

Caution--New York is the only state that prohibits the transportation of handguns without a license. Travelers should therefore be particularly careful since they face severe consequences should they inadvertently violate the state`s highly restrictive statutes.

Three out-of-towners found out the hard way not to fly with their firearms, cops said yesterday.

 

The men all attempted to declare their weapons during baggage check-in at La Guardia Airport between Feb. 3 and Feb. 7, cops said.

 

Ticket agents called police to see if the weapons had been registered in New York state, which they had not been, sources said.

 

Arrested were Norman Dott, 67, of Lawton, Okla., Frank Rivera, 27, of Dallas, and Kamal Bradai, 34, of Tampa.

 

All were charged with criminal possession of a weapon, a spokeswoman for DA Richard Brown said.

Can you borrow one when you get there?

 

I'd seriously re-consider. Port Authority of NY NJ has been shafting people. You'll probably be fine, but I'd hate to see someone get jacked up by some PA cop with a hard-on for guns.

I would strongly consider shipping it to yourself by UPS or Fedex, or through a local FFL to an FFL at your destination. There is too much that can go wrong between NY and NJ firearms laws. Check the post viewtopic.php?f=19&t=6883 for an example of a guy following the law but still was jailed and spent 3 years in a legal fight to prove he was innocent.

Don't know about UPS but FEDEX won't let you ship a gun to yourself. A FFL at your destination can't transfer a gun to you unless you are resident of that state.

I have heard horror stories about NY airport police ignoring the federal laws on interstate transport and prosecuting people. My recommendation--find another airport to fly from.

 

I flew to Nevada with a declared handgun out of Newark. Fortunately, I had no problems. Even so, I'm tempted to consider flying out of Lehigh Valley, PA next time.

I flew out of Newark to Pittsburgh. You have to declare a firearm to your carrier at the check-in desk. They have to fill out a firearms declaration tag then have you sign it and place it in the case. Someone comes over and escorts you to a side room and they ask for the key and take the case inside. I don't like this cause you can't see what is occurring. They then give you back the key and you go on your way. The locks on the case must be non-TSA approved. You are to be the only person with a key to the lock. When you claim your baggage sometimes it comes on the over-sized luggage carousel.
