Question: What exactly is the rationale for NJ basically giving automatic CCW status to retired police officers?

Not really..it was brought up every year by the PBA and FOP and denied by the legislature..NJ was also one of the last states that did not automatically grant CCW to retired LEO's...the push to get HR 218 started was also part of the reason NJ had to change..it took, IIRC almost 10 years to finally get 218 passed

Thanks for that reference. I am glad it finally got the retired LEO's whats supposed to be non discriminating rights.

While I dont like Fed trumping State's rights, I wish something similar could be passed for ALL eligible citizens.

NJ is not issuing them CCW's to comply with federal law. They are illegally trying to regulate a federal law even further...aka the Second Ammendment! It is smoke and mirrors way for them to regulate and keep a list of retired LEO's with guns, just like regular gun toting individuals. Its a complete joke and illegal. Problem is too many cops will just roll over follow the rules than fight back. Not to mention the PBA literally turns their head instead of fighting it.

 

If you read HR218, a "qualified LEO" can carry "notwithstanding any other provision of the law of any State or any political subdivision thereof..."

 

Meaning NJ has no right to make a retired LEo register with them. Do most....yes! But the bottom line is, just like others charged under state law for being a LEO and carrying (in states other than NJ), every case has been sucessfully appealed with HR218 as the defense.....even in super liberal gun hating California.

 

Don't think the state is giving retired cops a pass on BS/regulations....they are trying to control/limit it themselves!

#1...NJ's law went into effect before 218. What NJ sees, is a revenue stream... Whether or not they ahve the "Right' to do it, the State AG made the decision when 218 was passed that we here In-State still have to have our permit to carry..although any other LEO from any other state can carry without it. Until the day we get an Ag to reverse that, the current process will stand, and the state will get it's $60 every year, and the instructors will get their fees twice a year
