Note that NJ is not in the situation of IL, we have a carry permit law. This suit just seeks to strike down the "may issue" part of it. If that happens, the rest of the law will remain in force (including the qualification requirements.) Theoretically, no further legislation would be required to comply with an order similar to that of the 7th Circuit or that of the Maryland District Court. Which would leave carry permits I the same place as permits to purchase or FPID, I suppose (remember, those are nominally shall-issue by state law already.) The big question is whether NJ would appeal a ruling similar to the one handed down by the 7th Circuit or not. Sent from my DROID RAZR HD using Tapatalk 2 -

NJ won at the district level, not the circuit level. Third Circuit just heard oral arguments for our case per earlier posts up-thread. I had forgotten about the NY cases, but I don't think they've been argued or decided at the Circuit level yet. (There's an interesting one out of NY that hinges on what "arms" are; does the term cover things other than firearms, in this case nunchaku?) Sent from my DROID RAZR HD using Tapatalk 2 -

That's the first Circuit Court decision after Heller and MacDonald. 4th Circuit was argued in November, and the third circuit is argued next year, yes? -

FWIW - one of the laws struck down in Heller was a safe storage requirement; DC required firearms to be stored in a locked safe or disassembled, and SCOTUS directly struck that down on both parts. Whether the NJ law is distinguishable, I couldn't say, not being a lawyer. (I do, however, secure my firearms from casual access) -

We fill out a CoE in PA to buy a longarm because of federal law, which requires FFLs and purchasers to follow the laws of the purchaser's state when buying longarms out of state. -

By the letter of the law, .22lr isn't handgun ammo, not being designed exclusively for use in handguns (think about what the "lr" stands for.) -

The various nationwide reciprocity bills all require honoring out of state permits at the least restrictive of graduated permits, so grandfather clauses won't help. If any CCW is allowed, the out of state permits must be honored -
Remember, it be unconstitutional in NJ for a police officer to even request to search your vehicle without reasonable and articulable suspicion, at which point he didn't need your consent. Recent case extended that to a disabled vehicle on the highway. (I am on mobile, do not have cite handy. Google will find the relevant cases pretty easily.)

An FID allows possession of an unloaded longarm (except on the grounds of an educational institution). No need to muck around with the exemptions. -

On the other hand, they really are there and answering phones until 5 pm, at least the one time I walked into NJ Firearms Guild at 4:45 pm on a Saturday with the idea of buying a .22lr bolt-action. The paperwork was actually finished after 5 pm.- 13 replies

My argument about NJ gun laws

For all the folks banging the "news training to foil a bad guy" drum, read some of the incidents that get written up in American Rifleman in that self-defense column some time, or look at need reports of same. Most of the time simply displaying the ability to defend is enough. For the rest, see the recent decision out of Maryland - the existence of the right is sufficient justification.
