Never shot. Let's say, never out of box. Manufacturer to Distributor to Dealer #1 to Dealer #2 to Customer to Dealer #3.

 

New or Used? And when does it it change?

Became USED on going from Dealer 2 to Customer on a 4473

Even if Customer never took it out of the box before he sold it to Dealer 3, it's still NOT NEW, as it has already been papered.

They advertise them as NIB (new in box) on GB sometimes. I'm thinking that it's like when you rate a gun as 99% and not 100% when you sell it. It's still new in the box, but it's not new new since it was purchased and resold.

That's an interesting question. It seems a private seller would never be able to sell a gun as new. That might be true for a private sale p2p form, but if I were to list it in the classifieds it would be up as New In Box".

I think marking it as New might get you a call from the NJSP. New implies from the manufacturer; the 4473 signals the end of the "New" phase.

 

Of course, that begs the question. If a gun in stolen from a gun store and then sold to someone privately in a legal (from the buyer's perspective) transaction, would that gun still be considered "New"? :scratchhead:

I would say "New" on the forms, since for that purpose I would view it as new, assuming you didn't screw with it or whatever.

 

In a listing I would be sure to mention it's never been fired, and therefore new, even if the box has been opened. It would still, I imagine, depreciate somewhat in value, but not much.
