I hope he is successful in filing & winning a civil case against Jersey-City. Even though his case got dismissed he did spend almost a month in jail. All for nothing...

I hope it doesn't end there. His life was ruined. He lost his job and had to pay legal bills. JCPD also needs to learn a lesson. Always get a warrant or get consent.

The case was dismissed because of a bad search.  Probable cause, incident to arrest, and/or exigent circumstances permit search without warrant.  AFAIK his guns were illegal in NJ.

 

The comment was made by the judge not Nappen.  The PC for the search wasn't there or the cops were not able to articulate it. 

 

He's still not getting his guns back.
