Victim or Suspect/Actor?

Recommended Posts

When a man in New Jersey defends his home why is it that he is brought to headquarters for questioning and the burglar that got shot is brought to the hospital as a "victim"?

I sure hope one day that law makers in New Jersey can figure this out.

Resident shoots man trying to break into Berkeley Heights home

by Rohan Mascarenhas/The Star-Ledger

Tuesday May 12, 2009, 12:17 AM

BERKELEY HEIGHTS -- A resident shot a man last night when the would-be intruder tried to enter a home in the Deserted Village of Feltville, authorities said.

The shooting in the secluded section of Watchung Reservation occurred around 9 p.m. on Cataract Hollow Road, Union County Police Chief Dan Vaniska said. He said the victim, whose name and address were not available, was taken to Morristown Memorial Hospital and was listed in stable condition.

"An unwanted guest forced himself into the residence and a resident responded by shooting him," Vaniska said at the scene.

Details were scant last night, but Vaniska said the home's residents were brought to county police headquarters, where they were being questioned.

It was not known where on the premises the shooting occurred, but a sedan parked near the porch of the two-story, wood-frame house had a shattered left rear window.

Cataract Hollow Road is part of the historic Deserted Village of Feltville. The site in Watchung Reservation was inhabited by small businesses, a mill and families on and off from 1845 to 1916. Visitors can stroll the village, which includes homes the county leases.

Vaniska said he knew of at least three families who live in the village.

An investigation is continuing and Vaniska said he could not address charges at this point.

The "victim" part is stupid, agreed.

I'm not sure it's unreasonable to bring someone who shoots someone in their home to the police station. I would expect to need to go to the station. Someone got shot, and they need to figure it out.

I do know that I wouldn't even think about talking to them until I had a lawyer sitting next to me.

Maybe it's a better idea to chase them with a bat, just don't hit them or they might get hurt and sue. 350321665_Ltd5u-Ti-1.gif

The only thing that is questionable is whether the fight was brought outside the house..

It was not known where on the premises the shooting occurred, but a sedan parked near the porch of the two-story, wood-frame house had a shattered left rear window.

But to look at it differently.. I guess if you chased the robber out of the house, you should just wave to them as they run away.. saying thanks and please come back again?? It's a real loose loose situation!!

What the hell is "unwanted guest" comment about? Aren't all burgulars "unwanted guests"?

I dont think there are enought details out yet, but this sounds like a domestic dispute gone bad, not a shooting of a burglar in defense of ones home.

Can you keep us posted?

Shooting stirs calm of Deserted Village in Berkeley Heights

by LIZ KEILL/Independent Press

Friday May 15, 2009, 2:13 PM

BERKELEY HEIGHTS -- The serenity of the Deserted Village, within the Watchung Reservation, was shattered Monday evening, May 11, when John Pauer, 35, of Rahway reportedly confronted a resident, Joe Dugett, at his home in this village, commonly known as Feltville.

Union County Police received a 9-1-1 call at 9:15 p.m. that an individual was bleeding from gunshot wounds. Mr. Pauer entered Mr. Dugett's home uninvited, according to a statement issued by Daniel H. Vaniska, Chief of Police for Union County.

Mr. Dugett told police the Rahway resident had been harassing his family and forced his way in the front door. Mr. Dugett responded with a .380 semi-automatic pistol, wounding Mr. Pauer's upper torso and left arm. He was taken to Morristown Memorial Hospital and was listed in stable condition, police said.

Chief Vaniska said the intruder has been charged with burglary with intent to commit assault, making terroristic threats, criminal trespass and simple assault. No charges had been filed against the occupant of the home. Bail had not been determined at press time.

The isolation of the Union County-owned Deserted Village, officials noted, can make it a vulnerable site for intruders. Only a handful of houses are located at the site, off of Glenside Avenue in the township.

The village was at one time a thriving community of mills and a printing factory, a company store, a one-room school house, a church and home to 300 to 400 inhabitants.

Peter Wilcox, an Englishman, originally settled there in 1736. The site was purchased by David Felt in 1825, a New York City printer and stationer who was looking for property to construct a mill to manufacture paper for his business. Mr. Felt built a stately country home, with broad veranda and views of the surrounding countryside. According to records of the time, "King David" ruled the village and his employees with a strong hand.

But, as business fell away, so did the inhabitants. Warren Ackerman revived the village in 1882 as a summer resort, called Glenside Park. That, too, was deserted, and the Union County Park Commission bought the property in later years.

At the scene of the shooting on Monday night were the Union County Sheriff's Mobile Crime Scene Unit, the County Police Forensic Ballistics Unit and County Police Emergency Services Unit, as well as county police and detectives.

Union County Police Detective Scott Pentz is conducting the investigation.

Baseball bats are a bad idea. The VPC will get wind of the rise in crime with Assault Bats, they will lobby to limit the length to a safe non concealable size. Bat day at the stadiums will be over. Then limit how heavy it can be so as not to cause too much damage. Do not even think about puting pine tar on a wood one. The punishment for illegaly altering a piece of hickory is mindblowing. The horrors of it all.

Deserted Village intruder sent to psychiatric center

by LIZ KEILL/Independent Press

Thursday May 21, 2009, 9:35 AM

BERKELEY HEIGHTS -- John Pauer, who allegedly broke into a home in the Deserted Village in the Watchung Reservation, has been sent to the Trenton Psychiatric Medical Center, Union County Police Lt. Robert McGuire said earlier this week.

Mr. Pauer, 35, of Rahway confronted resident Joe Dugett, 65, at his home in the village on Monday evening, May 11. Mr. Dugett, a former member of the Secret Service and an Army veteran, shot the intruder twice with a .380 semi-automatic pistol. Mr. Pauer was injured in the upper torso and left arm and was taken to Morristown Memorial Hospital. Mr. Dugett's wife was inside the house at the time of the incident.

According to police, Mr. Pauer had been a son-in-law of the family, although the Dugetts' daughter is now remarried and lives in another state.

Union County Police received a 9-1-1 call at 9:15 p.m. that an individual was bleeding from gunshot wounds. Mr. Pauer entered Mr. Dugett's home uninvited, according to a statement issued by Daniel H. Vaniska, Chief of Police for Union County.

Chief Vaniska said the intruder has been charged with burglary with intent to commit assault, making terroristic threats, criminal trespass and simple assault. There have been no charges against the homeowner. Lt. McGuire said decisions regarding a trial will be determined by the county prosecutor's office.

After you hit them with a bat you will probably get a 'random' drug screen to see if you have performance enhancing drugs in your system.

Or an offer from the Mets.

You are dealing with a reporter who has to make a story sound spectacular. They also have to make it sound different from the other stories filed so they come up with new terms. Years back when the law changed from 2A to 2C, suspect, perpetrator and all the other descriptions were changed to "actor" in the statutes. That confused the hell out of them. To get upset over what is pri[*]ed in the press is a waste of time.
