Something to watch out for at the PD

Recommended Posts

Did you send it to the NJSP or NJAG?

NJAG. I called the NJSP and pardon my language but the detective who I spoke to was a F***ing moron. He told me the local departments can require whatever they like. Glad you people don't know the laws you're supposed to enforce.

He was the person the system gave me when I pushed whatever number for firearms questions. I hate this state. It uses the Constitution as a toilet seat liner and wipes it's budget bloated corrupt a$$ with the Bill of Rights.

UPDATE:

I finally got a response. Took one month for the response, one month to mail out the letter, and one day for it to get to me from Trenton. I received it yesterday.

So they just referred you to another department. That's kinda typical of the state government right now unfortunately.

Well at least the State Police got back to me quickly. I don't know if my original message was sent when they forwarded it so I resent it.

Dear Mr. XXXXXXX,

In reference to your e-mail inquiry of April 27, 2010, received by this unit on June 24, 2010, regarding information a municipal police department is allowed to require in an applicant

I was having the same sort of problem. I live in Belmar and they gave me 2 pages extra of stuff to fill out.

Since I don't have an FID card or even one pistol yet I just filled it out. When I get my eventually go back for more permits I plan on challenging the paperwork if it's giving to me again. I don't feel like rocking the boat until I get my FID card in hand.

I didn't know any better when I first went for my FID. When I decided I wanted another pistol they had added the part about credit bureaus and I instantly turned into the old man with the beard waving my cane . So after 5 months of the getting the run around I just dropped off my forms without the additional paperwork. They called me back to sign another form and I was ready to argue with a printout of the statute in my hand. They just needed a signature for the release of my prints. I put my printout away, signed the sheet, and had my permits in 4 weeks.

ChrisJM981, your experience makes me realize how foolish it was of me to sign a similar waiver when I submitted my FID application two weeks ago. I don't feel there is really anything my PD could dig up about me that might disqualify me from receiving my FID Card, but I'm ashamed of myself for submitting to such an invasion of privacy.

On the subject of that, does anyone know what a police department is capable of in terms of gathering information? Can they track internet records and activity? I would certainly hope not.

Short of the "disabilities" listed in the reply you received, are there any other reasons someone may be denied an FID?

I'm not a lawyer, but I would imagine that would require a search warrant for your ISP and I can't imagine a situation where a background check would be sufficient cause for issuing such a warrant. No one will know about the freaky porn sites you're going to ;)

Try contacting Dan Schmutter at ANJRPC (Association of NJ Rife and Pistol Clubs) he is in charge of permit issues and they want to know about any violations and rationing. His email is [email protected] and phone number is (973)214-6298. Hopefully this organization can put even more pressure on your PD's. Good luck!
