Buying handgun FTF from someone with an invalid FID card

Eventually I will be turning in my paperwork for pistol permits so I can transfer my dads handguns to me. The thing is, his FID was issued about 40 years ago and does not match his drivers license. My FID matches my drivers license. Is there a problem here? If not, my question is, should I put down his FID number on the Certificate of eligibility or leave it blank? But if I am correct, the COEs arent turned into the state or local authorities so they wouldnt know either way. I dont recall if the seller's FID # is needed on the permits which will be turned into state and local PD(if i recall correctly)

 

Google fu says no COE for handguns, permit is used instead. So my question relates to the last sentence. Thanks!

I believe you can still transfer guns out if you do not have an FID, so I would treat him as a non-FID holder and leave that field blank. As far as the state is concerned, an invalid FID is no FID. This is of course my speculation, and I am not a lawyer, so...

Except that your SBI number (number on your FPID) is your number for life if I understand correctly...

Thats what I've read and been told if my dad were to update his FID. I am just wondering if the non matching info is an issue. Surely the authorities check pistol permit info they receive?

I think "invalid" is the incorrect term.

 

NJSA 2C:58-3

 

(f) f.Granting of permit or identification card; fee; term; renewal; revocation. The application for the permit to purchase a handgun together with a fee of $2, or the application for the firearms purchaser identification card together with a fee of $5, shall be delivered or forwarded to the licensing authority who shall investigate the same and, unless good cause for the denial thereof appears, shall grant the permit or the identification card, or both, if application has been made therefor, within 30 days from the date of receipt of the application for residents of this State and within 45 days for nonresident applicants. A permit to purchase a handgun shall be valid for a period of 90 days from the date of issuance and may be renewed by the issuing authority for good cause for an additional 90 days. A firearms purchaser identification card shall be valid until such time as the holder becomes subject to any of the disabilities set forth in subsection c. of this section, whereupon the card shall be void and shall be returned within five days by the holder to the superintendent, who shall then advise the licensing authority. Failure of the holder to return the firearms purchaser identification card to the superintendent within the said five days shall be an offense under subsection a. of N.J.S.2C:39-10. Any firearms purchaser identification card may be revoked by the Superior Court of the county wherein the card was issued, after hearing upon notice, upon a finding that the holder thereof no longer qualifies for the issuance of such permit. The county prosecutor of any county, the chief police officer of any municipality or any citizen may apply to such court at any time for the revocation of such card.

 

 

I suggest that your father's FID is not "invalid." Rather, the information between his FID and NJ ID doesn't match. I don't know if that has any ramifications for the transfer, though.

 

I think the whole "your NJ driver's license and FID address have to match" is a fallacy perpetuated by FFL's and the NJSP.

This is correct. I would record his SBI number and current data from his driver's license. A FID is not needed to sell a gun.

Yeah, when people move there permits are still associated with the address they were assigned to. But the SBI number is always the same, its kinda like a SS# in its sense of use.. in the firearm database. The seller doesnt need a Valid FID so it doesnt really matter, they must reside in NJ tho. He can still use his SBI# though, not sure if its required if you have one.
