Is Magpul PRS Gen 3 Ok in NJ?

who the hell can tell in this dumb state. the butt pad can be moved like an inch, but the stock itself is fixed on the buffer tube

assuming it's legal and is a fixed stock, this means that i'm free to have 1 other evil feature, correct? so i don't need to pin the muzzle brake?

Why would you not need to pin the muzzle brake? An AR with a pinned collapsible stock is the same as an A2 stock. It still had a pistol grip and detachable box magazine.

 

The previous version of the PRS is arguably NJ legal, no different from the Gen 3.

A semi-automatic rifle that has the ability to accept a detachable magazine and has at least 2 of the following:

 

 1. a folding or telescoping stock;

 

...

 

So this hinges on the word "telescoping".

 

 

v. tel·e·scoped, tel·e·scop·ing, tel·e·scopes

v.tr.

1. To cause to slide inward or outward in overlapping sections, as the cylindrical sections of a small hand telescope do.

2. To make more compact or concise; condense.

v.intr.

To slide inward or outward in or as if in overlapping cylindrical sections: a camp bucket that telescopes into a disk.

 

Gray area - AFAIK no one has been charged/convicted in NJ solely for having an adjustable as opposed to folding/telescoping stock.

 

Does the PRS have overlapping sections that slide?  No

 

Does adjusting the PRS to its shortest dimensions make it significantly more compact?  No, and the adjustment cannot be made quickly.

 

If charged, you might argue that the intent of the folding/telescoping stock ban was to prevent ownership of weapons with stocks that make them easier for concealment and can quickly change length.  PRS doesn't do either.

 

You might also argue that the stock itself is fixed and only the butt pad is adjustable.
