How to buy shotgun from out of state friend?

I have a friend coming home from California for thanksgiving.

They have a hot deal on a FN Tactical Police Shotgun out there at Turner's.

 

Since he's coming home can we just do a face to face or would we have to go to a gun shop/FFL and do it through there?

Wait....

 

Has to go thru FFL.... you might as well buy it and ship out here to FFL directly...

 

You dont even have to involve your friend.... nor should you.... just makes it complicated

nor should you.... just makes it complicated just makes it a straw purchase. Granted it'd go through an FFL later but the law says you can't buy a gun with the intent to sell it to someone else unless you are an FFL.

 

If you friend DID have a gun, he could bring it to an FFL in NJ and transfer it to you if he just bought it and changed his mind about the gun.

 

Easiest just to buy it directly.

Turner's won't ship it out of state.

If they would ship to NJ, you could just have them ship it directly to you. No need to use an FFL if buying new from a dealer.

 

 

Umm no... if it is being shipped it HAS TO GO THROUGN AN FFL. That said, OP, is your friend an NJ resident or a Ca resident? If he is an NJ rsident, he can legally pourchase the shotgun in Ca, and leter Sell it to you. Of course if he purchased it with the SOLE PURPOSE to transfwer it to you, it would be a Straw Purchase according to ATF. But since that isnt the case, if he should buy it for himself, and decide later on that he really deosnt Like it all that much..no harm no foul. NOW, if he is a Ca resident you cannot FTF transfer it here it would have to go therough an FFL, most will do it for a Nominal fee.

Regarding straw purchases, when I was waiting for a NICS check the other day I was looking at the counter mat the ATF gives the FFL's (Don't lie for the other guy) and I thought it said a straw purchase was if you purchase a firearm for a person who is INELIGIBLE to buy one on there own (as opposed to buying one and transferring it to someone who could buy it on there own).

 

Does anyone know if this correct?
