I was in a Wal Mart that was close to the NJ border years ago (Port Jervis) and was asked for my DL when I purchased a BB gun. Upon learning I was a NJ resident, the clerk asked for my FID. They even had a sign hanging at the sporting goods register stating this policy/law. I suppose if you drove further into PA it wouldn't be an issue.

I'm surprised they busted your chops about a BB gun over there, Most stores in NY, PA and the rest of America have them out on the floor (along with the cheaper ammo). You simply take them off the shelf yourself and bring them up to the register and pay for them like it was any other item in the store.

Watch it with BB handguns -- I believe they need to be on a handgun permit so if you buy one in PA (which is legal for PA residents) and bring it back to NJ you will have a problem.

 

Not really, you only need a pistol permit to purchase a BB pistol in NJ because NJ is violating federal law by regulating the sale of air guns, specifically 15 U.S.C. §5001(g)(ii)... Imagine they charge you with a violation of a state law that is preempted federally for something you purchased in another state. I'd love to be in the courtroom for that case.

Actually, they'd probably nail you with violating 2C:39( b ) [or ( d ), not sure if BB guns as "firearms" classifies BB gun pistols as "handguns" or "other weapons"].

 

I don't think there's anything inherently illegal about buying a BB gun (rifle or handgun) in another state and transporting it back to NJ. (That's not to say you couldn't be arrested/charged with something...)
