Garcia has spent time behind bars for aggravated assault, weapons possession and making terroristic threats, according to judicial records, while Hamilton’s record includes convictions for drug distribution, conspiracy and hindering prosecution.

These guys are 30 and 23. Their convictions are probably a small fraction of the number of their arrests. Why were they let out?

Prediction: They'll serve a couple of years, be let out again, and get arrested for much more serious offenses soon thereafter. People like these are the bread and butter of the judicial system. They have as much chance of rehabilitating as I have of growing a second penis. A big, strong one.

Inside, they found a Bushmaster Carbon AR-15 rifle, a high-capacity magazine for the gun, a semi-automatic .40 caliber Hi-point JCP pistol and 28 live .223 caliber rounds, according to authorities.

What am I supposed to be outraged about? I agree thee nation of the bullets adds diddly to the story, but it's not like they were arrested for legitimate reasons.

Assault rifle?

as·sault ri·fle
noun
a rapid-fire, magazine-fed automatic rifle designed for infantry use.

Bushmaster Carbon 15?  Not likely.

Then again...

I am at a loss as to where the OPs confusion is as well.

Yes. We all know the true definition of Assault Rifle. It is completely different to the actual definition by a large factor - that being the ability for select fire.

However, the NJ legal definition is what it is, even if it is "technically" incorrect.

Look at what NJ calls a short barreled rifle. Just because they call it a "sawed-off shotgun" doesn't make it any less illegal to own in NJ.

    • Ignoring the Duty To Inform, this is definately going to be used against us CCW holders during the current court hearings.  Drinking and randomly shooting a gun out the window does not paint a good picture for CCW holders.
    • Getting a non-threaded barrel is easy.  I'd definitely consider it as having a form of a shroud for #3.  The question is does it actually violate #1?  If so is there another chassis option that does not have mag holder VFG?
    • So, as I interpret things, you get a hit on #1. It says nothing about feeding from said magazine, just that the magazine attaches to the pistol outside of the pistol grip. And it is attached. Was this what was considered when it was written? 100% no. However, this is NJ and I don't think they would give you an inch when as written it covers it in plain english.  #2 would be a hard yes if you put a threaded barrel on your setup, so I'd not do that.  #3... well it's not a shroud, but it does allow you to hold the firearm with the nontrigger hand without being burned. Shroud is ill defined, and it could be argued to partially enshroud the barrel from the bottom. I would bet cash money that the AG would gladly say that second part there is to clarify the intent of the law and that since you can do that, you violated the stated intent of the law.
    • I don't know why we ( NJ gun organizations ) have not yet filed a lawsuit on "duty to inform"  A clear violation of the constitution 5th and probably 4th.  Maybe this guys lawyer will and get that charge dropped.  what other right do you need to inform a law enforcement officer of.    are you required to identify as a republican or democrat during an encounter, and by the way,  what constitutes an encounter.  voluntary? involuntary?   time to get this one knocked down. come on ANJRPC stop waiting for court decisions and go on the attack.
