NJ Resident buying gun in TN

I would have simply asked this in chat, but nobody was around - sorry for the new topic for a short question.

 

I know a gun can be brought can into the state as long as it was purhased legally in another state, but does the same apply to handguns? Is there any issue buying a handgun in TN and then transporting it to NJ?

 

Anything else pertinent I should understand before attempting this?

Any handgun purchased out of state must go through an ffl. If you bought in TN gun would have to be shipped to NJ FFL and transferred to you.

As pointed out above, that is the way it is done. What your describing is if you were a resident of TN, boght it in TN legally and then moved to NJ. That would be okay.

 

If your a NJ resident, you need to have the gun transferred to a NJ FFL and then go through the normal pistol purchase process.

The out-of-state handgun rule is a Federal rule.... Not NJ.

Thanks guys. What about a long gun? I bought a shotgun at Davis in Sloatsburg. Can I buy a rifle at Cabelas in PA and drive it home. What about a rifle here in TN and then bringing it home with me?

 

The guy at the pawn shop wasn't sure if he was allowed to sell me a rifle.

You are OK federally with a long gun, but there may be prohibitive state laws. Some states only allow purchases from contiguous states (that's the way the federal law used to be). Regardless, you'll have to find someone willing to sell to someoen from NJ and you still need your FPID and a COE for yourself and one for the seller, in order to be in compliance.

Just a small update.

 

I ditched my efforts in TN - nobody wanted to sell me anything. NJ residents really scare the shit out of some retailers.

 

I make the trip to TN with my family every year - we have 3 boys so I like to drive through the night so they can sleep for the majority of the 16 hour trip. So I decided to stop by the Cabelas on 78 in PA as it was opening and I was the second in line at the gun counter. The salesman was very helpful, seemed to know his stuff, and was very patient as I made my decision.

 

The problem was, once I picked the .22 I wanted, it took an additional 90 minutes before finally completing my purchase. Christ, and I was on no sleep having just driven all night.

 

The salesman fills out a form and gets my DL and FID card. Then I'm escorted to a computer where I fill out my info and questionnaire. Then I have to fill out a paper version of the exact same form. Then a 30-minute NIC and another 15 minutes while the cashier fills in more information and takes my payment.

 

I bought a pistol at Luciano's and it took all of 10 minutes. A stupid .22 from a big retailer, 90 minutes.

In order to be in compliance? I win the auction, my local FFL is already a registered Gunbroker FFL, so the guy selling just ships it to my FFL. What I don't understand is where the COE comes into this? Do I need to send one for the buyer to fill out & ship with the gun? Or does my FFL do that, or what? (rifle, NJ legal).

I think you meant to ask if the seller fills a COE out. No. The dealer from whom you acquire the firearm from, and you fill out the COE.
