Please Attend Hearing in Person!

As anticipated, Senate action on S993(gun ban / mag ban) is now set to resume with a hearing of the Senate Law and Public Safety Committee officially scheduled for 10:30 a.m. on Monday, May 5. Gun owners, hunters and sportsmen need to immediately tell members of the committee to oppose this blatant attack on their rights that will not affect crime or prevent another tragedy.

If you are able, please plan on attending the hearing in person and testifying (Committee Room 10 in the State House Annex, 125 West State Street, Trenton, NJ 08625 - time and location are subject to change).

Please also continue to contact Governor Christie and urge him to oppose S993.

Also, while there is not yet a Senate version of A2777 (firearms transportation issues), the Assembly version is shown on the agenda for May 5. Accordingly, please also immediately tell the members of the committee to make the following one-word amendment to A2777 to restore judicial discretion on firearms transportation issues:

For the purposes of this section, "deviations as are reasonably necessary" means includes collecting and discharging passengers whose transportation is permitted under paragraph (2) of subsection b., subsection e., or paragraph (1) or (3) of subsection f. of this section, purchasing fuel, using a restroom, and contending with an emergency situation. A person transporting a weapon pursuant to this subsection shall comply with all other applicable State laws relating to weapons.

Yes but.  During the assembly hearing the bill sponsor was asked what he considered "contending with an emergency" would include.  He agreed that a flat tire would be one, but rushing to school to pick up a sick child would not.  So, as always its a case of potential law that is as clear as mud!

It looks like the bill that was passed by the Senate today had been amended on May 5th:

As amended, the
bill defines “deviations as are reasonably necessary” to mean
collecting and discharging certain passengers, purchasing fuel, using a
restroom, contending with an emergency situation, and other
reasonably necessary deviations of no more than 15 minutes in
duration. The committee amendments expand the definition of
“deviations as are reasonably necessary” to include reasonably
necessary deviations of no more than 15 minutes in duration.

 

The last clause "and other reasonably necessary deviations of no more than 15 minutes in duration." seems to add judicial discretion back into the law. It is still not perfect because of the 15 minute duration but definitely better than it was without it.

Better hope there's no line at the tp rest stop bathroom.....it'd definitely be more than 15 mins...lol not to mention...still not "legal" to stop to eat...even if under "reasonably necessary" good luck getting served and eating in 15 mins....

So does the 15 minutes apply to all of the exceptions or just the "reasonably necessary deviations"? After Sandy it was a bit more than 15 minutes to get fuel!

 

The 15 minute limit makes as much sense as a 15 round limit in magazines.

 

I would expect these to get tied together in the future

(10 min, 10 round.......7 minute, 7 rounds etc....)

Fuel appears to be separately enumerated, so I don't think the 15 minute thing applies to it.  I think you can stop as long as you need to for fuel or using the "facilities."

 

I do, want a little more clarity though in re: the "recieve/discharge" passenger thing. If I want to pick up a person and go shooting with them at my range in PA, is that OK?

Good question. NJ doesn't seem to have an exemptions to leave NJ with a firearm so you would be under the federal FOPA. So is picking up a passenger on the way to PA covered under what? We need test cases  :maninlove: .. any volunteers?

Why doesn't anyone in the media talk about how stupid all these things are.  They need to equate this magazine crap into terms the average person could understand.  Maybe if it was stated that this is equivalent to banning all cars that can go faster than the maximum legal NJ speed limit of 65mph people would understand that this law does nothing to change behavior - it just takes away property that you paid for.

 

The time for bitching is over, its now time to contact the governor politely and urge him to do what he did last year and veto the stupid magazine bill which he called arbitrary when he did it last year.

Because they're all "in favor" of them... :facepalm: At least the national MSM is... Or they work for / depend on funding from, people who are in favor of them.

 

 

They need to equate this magazine crap into terms the average person could understand.  Maybe if it was stated that this is equivalent to banning all cars that can go faster than the maximum legal NJ speed limit of 65mph people would understand that this law does nothing to change behavior - it just takes away property that you paid for.

By your example, then, the govt. and law enforcement would be the only ones allowed to have cars that did 66-110mph. This, to be able to overtake anyone who didn't (theoretically) have such a car. I guess they're afraid of all the "law abiding" people that might defend their constitutional amendment to drive cars that can do 110-120mph and evade LEO chases.
