Do I need FPID to transport long guns, do I need to lock them etc

A better answer about the guns might have been: "I respectfully would not like to answer that question". But if they are in plain sight through a window that won't help. I cover up my firearms to try to avoid these situations (and as we know there is no legal requirement to do so).

 

One of the things I really don't understand is why do the courts find it OK for the police to lie to us but it is a crime if we lie to them?

The PRNJ should require their Stormtroopers to be versed in the laws. The PRNJ still resides in the U.S.A. not the USSR. The lack of knowledge of the law is half the problem.

 

I have multiple friends who are police officers. Just last week I had to explain the status of hollow points to a State Trooper friend of mine. It came up when discussing the Meg Fellenbaum Story. He thought hollow points were banned in NJ. He has never bothered anyone for them; except to add to the charges of gang bangers and drug dealers. He was surprised to find out that they can be possessed and transported just like a handgun.

At 5:50 it appears that they radio to firearms investigation unit and the lady reports back his handgun purchases.

 

Why were they demanding to see his FID card when they could just look up his SBI + his handgun purchases?

I'm guessing so they could get him on another ticket for failure to produce documents? Which I assume you do not have to have your FID on you, you just need to have one? Thus why he didn't get a third ticket? Can anyone confirm that?

I think if you are not going to/from an exempt location then you must have your FPID physically with you.

From what I found unless it has been overturned State v Repp says you only need to be issued a FPID in order to carry a long gun. This would mean you don't need to have it on you. Which my guess is that's why he didn't get a ticket for it.

So why am I watching a video of a Stop with a court date that was 2 1/2 YEARS ago?  I remember reading about this on FACEBOOK.  Years ago.

 

No you don't need your NJFPID card on you.  If it was a crime to NOT have it, then every out-of-state non-resident competitor in every shooting discipline using ANY platform would be guilty of a CRIME!

 

THINK PEOPLE!

 

Now as to the actions of the officer, well, when you look-up SCHMUCK in the dictionary, his picture is THERE, lol!

 

As a Second Amendment leader of NJ's most active 2A group, it's my opinion that should NJ ever become a FREE STATE w/ civilian CCW, a LOT of hard-asses are going to need re-training and/or retirement.....

State v Repp says you have to have obtained a FPID unless you are specifically exempted in a statute.. In that case the NJ Supreme Court overturned a superior court which had overturned the original conviction of Repp because he did not have a FPID. Repp had said that he had purchased the shotgun prior to the 1966 Gun Control Law and thus wasn't required to have the FPID. The Supreme Court stated that at the time of his arrest he wasn't traveling to an exempt location and thus was required to have obtained a FPID.

When the legality of a person's conduct under this chapter depends on his possession of a license or permit or on his having registered with or given notice to a particular person or agency, it shall be presumed that he does not possess such a license or permit or has not registered or given the required notice, until he establishes the contrary.

So it there isn't a violation for not having your FID on you, but it will definitely make for a bad day.

Myself I don't worry about that as an issue, But I do keep it in my wallet, just always have for many years. My reason is, I want it if I stop in A shop and find A deal on A firearm I want to buy, Or if I run across A deal on some ammo (handgun). that the FID is needed for.  That actually happened 2 times when I made stops at Cheyenne Outfitters up there in the other NJ. If I didn't have it with me I would have missed out on A couple deals..   Because I wouldn't driven back across the border to home and back to get it.

 

Just my reason for carrying it.

And those are very good reasons to carry your card. And because you so clearly said you don't need to have it to transport, you are not gonna get flamed.

I carry mine for the same reason too.

 

There can be no ticket or arrest for not having it on you when transporting an unloaded long gun. However if the LEO decides to follow the letter of the law they can certainly assume you don't have a FID and make life annoying. They could detain you til you prove you have a FID. However it wouldn't be too hard to prove you did.
