Bruen allowed for permits, dude in Hawaii was carrying without one.

Judge seems like a hipster douchebag based on his comments...

One of the problems in this ruling - besides the total rejection of SCOTUS 2A rulings - is that they said he should of applied for a license - back in 2017, when HI didn't give licenses to civilians (like NJ, CA, etc..)

That's kinda how the law works. He would have applied, and when denied the constitutional issue has standing.

You basically do.... 

Proving you have standing otherwise has shown to be extremely difficult as they work on hypothetical situations that have to basically be certain to occur. 

Either way, he still would have had to most likely meet the requirements of the current permitting system, and also been denied a permit under their "draconian" system. 

 

Say he met all the requirements except for a "justifiable need" and was thus denied, I would say he easily has standing if he was arrested while carrying. That's what Bruen was explicit on.

Does this mean, in a 'John Belushi was right in 1941' sort of way, that we need to have the Germans bomb Pearl Harbor ??
