Philadelphia Gun Rights Rally and March

Recommended Posts

Since the mayor of Philly has made it illegal to carry in public parks this is civil disobedience. Join us at Love park in Philadelphia.

The 2nd Amendment to the United States Constitution states:

Quote: A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

Article 1, § 21 to the Pennsylvania Commonwealth Constitution states:

Quote: The right of the citizens to bear arms in defence of themselves and the State shall not be questioned.

And Title 18 § 6120 of the Pennsylvania Code states:

Quote: No county, municipality or township may in any manner regulate the lawful...possession...of firearms...when carried or transported for purposes not prohibited by the laws of this Commonwealth.

And yet, Philadelphia's Mayor Michael Nutter has signed into law an ordinance that SPECIFICALLY makes it a crime for people who are licensed by the State to carry firearms for self-defense to exercise their rights while in public parks.

    This is unacceptable. And ILLEGAL.

We will not be made into criminals. We will not be punished for the bad acts of others who have no respect for their fellow man. And we will not tolerate being restricted from exercising our freedoms just because some Mayor thinks he is above the law!

Join me on May 25th in Philadelphia as we protest this outright violation of State law, and make ourselves heard. March with me through Philadelphia, from Love Park to the People's Plaza for the "Save The 2nd" rally, and let us make sure the entire city knows that we are not going to allow our right to self-defense to be stripped away from us in a time when we need it the most!

If you have any way to contribute - sign making, bringing along a bullhorn, can provide snacks and refreshments while we march - let us know!

This sounds very interesting. Can someone please explain how the laws apply to out of staters open carrying in Pa?

Also, is transporting over the bridge legal if it is for demonstration purposes?

I would hate to get arrested for simply open carrying, which I think is legal, or by transporting my gun back over the bridge where the state police are waiting for us.

Listen, I understand what you are doing, and I appreciate it. But I don't think most people here do understand it.

Philly has also banned "Assault Weapons." Yet you can buy them in a gun shop in Philly. And if you wave them in a Philly cop's face, you will not be arrested, and certainly not charged.

Philly can't pass gun laws.

Now, I know there are people that want to challenge or change illegal local firearms laws in PA. I applaud them. But I don;t think people in Jersey would realize that these laws are unenforceable. And, when it comes to Philly, it's just a huge pile of political crap they do every day.

People in Jersey probably think well, they may be illegal laws, but you will still be arrested and charged and convicted and have to appeal. Nope. This is not Jersey. There may be a remotely possible chance that you could be arrested by a cop that doesn't know better, and I mean very remote, but nothing beyond that is remotely possible.

As far as PA is concerned, you must have a carry permit from any state to transport a handgun/Sawed-off shotgun/Short barreled rifle/small machinegun/small AOW by car, skateboard, or anything else other than your feet and shoes. Except to and from range. Almost the same As NJ.

If you can somehow get the handgun there legally, of course you can OC and walk around with it without any permit.

My understanding of PA Firearms law is that:

1)Open Carry is permitted, without ANY permit, everywhere in the Commonwealth EXCEPT Class 1 cities, of which Philadelphia is currently the only one.

2)A valid PA CHP (or one from another state that has reciprocity with PA) is necessary for ALL carry in Phila.

So how can anyone WITHOUT such a permit legally carry (open OR concealed) in Phila??

To and from the range. But you forgot the most important part.

3) You can't have an unloaded handgun in the trunk of your car without a carry permit.  anywhere in PA. Almost the same as Jersey.  To and from the range.

I'm getting really sick and tired of all these "OC is legal in PA with no permit required."

You plan to walk to PA?

You think this is a friggin joke and you can drive around with a handgun in your trunk in PA even though the laws are almost the same as Jersey?

(although the jail terms are less in PA, you will still never touch a firearm anywhere in the US for the rest of your life).

After you're all done being sick and tired, how about you ANSWER MY QUESTION:

So how can anyone WITHOUT such a permit legally carry (open OR concealed) in Phila??

Civil disobedience is one thing, but risking a state felony conviction just to protest Mayor Nutbag is quite another.

I would expect this rally will be closely monitored by the Phila PD and the PA State Police.

Valid licensees will walk free, everyone else goes to jail.

Then the expensive and traumatic adventures begin.

No thank you.

I can't fight for our rights in the PRNJ if I'm sitting in a PA jail.

It has exactly ZERO to do with New Jersey.

Except to entice us to become felons and thereby prohibited persons for life.

But that might just be the goal of that purported PA resident who would not answer my question:

So how can anyone WITHOUT such a permit legally carry (open OR concealed) in Phila??

Very not nice of some LE org to plant someone in the NJGF, but would you expect anything different of the tyrants in power these days?

Brian, i believe what Mipa was saying was, that although you can open carry anywhere in PA but a "Class 1 City" without a CCW, you can't legally drive to a place in PA that wasn't a range, gun shop, gunsmith, like NJ, without a CCW. So if you drive to PA and don't have a CCW from another state, you are breaking the law just as if you drove to a friends house in NJ without having a CCW. You would be in trouble for being in possession outside the exemptions.

That's the way I took his response. Granted a little dramatic but it is what it is

If I drove to the Firing Line is south Phila and park, I've successfully legally transported into PA.

I go in, holster up, shoot a few targets and then walk to LOVE Park open carrying.

Now what? ...

Spotted by a Rizzo Raider

I go to jail

Directly to jail

No passing GO

No eating cheesesteaks

And no more guns

EVER

My valid FL permit does me no good thanks to the PA Atty General

No thank you

I'll pass

People I'm not trying to get anyone in trouble here, I'm just trying to get some support. We go into NJ from PA to support various causes & several NJ libertarians I know are often over here.

You don't have to even have a gun much less carry it at the rally, your presence alone is enough. I plan on bringing nothing deadlier than my video camera.

"And all of this deals with NEW JERSEY how?" It doesn't directly deal with NJ. Since the tyrants work together across state lines & even borders we should too.

BTW, the NJ 2A Society regularly has a presence at gun shows here in PA. They are always more than welcome to come here to seek our support. I would think some reciprocation would be in order.

Technically you don't even have to shoot while at the range.
