Any problem with a walking stick in NJ ? Not necessarily a cane, but a old time gentlemans walking stick. Do these fall under any obscure NJ law ?

The reason I wonder is I believe their use at one time was self defense, hense it might be considered a weapon.

Would one need a reasonable explanation for having one on them at any particular time or place ?

There are some cool ones with 18 inch swords in them....more like a Bayonet. If you're actually walking with a normal stick, who's going to harass you for that?

I would venture to guess sword canes are mentioned by name In the weapons laws of New Jersey. A wakling stick is different than a cane usually thicker and somewhat longer. I have one made by cold steel I got as a gift some time ago but wonder if It would lead to trouble if I took it on a walk. Could it be considered a weapon ? I wonder.

When it comes to walking around with a bat, it could be considered a weapon. If you have a glove and a ball, then it's considered sports equipment.

 

So, if you have platform shoes, a wide brimmed hat, and a fur collared coat, then a walking stick is just a tool of the trade! :D

I believe sword canes fall under a concealed weapon.

 

NJ does not have a "concealed weapon" statute. All carry, whether concealed or open, is banned by law. Lawful possession of any weapon (including knives/swords) must fall within an exemption (such as keeping it at home, or using while hunting, fishing, or other legal activity that utilizes weapons).

 

In the case of a sword cane, possession of one in public puts you at risk of being arrested for Unlawful Possession of a Weapon and Possession of a Weapon for an Unlawful Purpose. Concealed or open carry is of no relevance.

how about a pencil in my pocket. Hold it in my fist and swing at your eye and now it becomes a concealed weapon. :x

I think that you would be fine with that as long as it doesn't have two or more of the assault pencil features...

My first post on this forum, and I am from next door in PA. I would like some current information on this subject since I am using a cane in PA and am planning a trip to Atlantic City.

 

Since this thread was from 2009, I am curious if anyone knows if any changes to NJ laws have occurred with using a walking cane for stability assistance. I've done a long search of NJ government web sites and only found bits and pieces of info but zero clarification on if NJ has laws concerning using a walking cane. Thanks.

The reason you can't find any laws in NJ on using a cane for walking assistance is there aren't any. Using that cane as a weapon can have implications. Disparity of force issues can justify you using that cane as a weapon. Being assaulted by a 6 year old you probably shouldn't smack him with a cane. Being assaulted by a 6'6 300 lb bodybuilder probably okay to use the cane as a weapon. Nothing black and white on this but disparity of force is a concept recognized even in NJ.

Thanks for the replies fslater and GRIZ, much appreciated. I understand disparity of force and self defense being a CC holder here in PA.

 

I think my cane will not have enough "assault weapon features" to make it illegal to carry in NJ. SOB. It is also NOT painted assault weapon black (!), thank God, so I should be ok. I know not to have a loose hollow point bullet rolling around in my car. Here in PA I always have my subcompact 45 on me with 10 rounds in the mag and one in the chamber, safety on, all hollow point police grade rounds. The Kingdom of NJ considers these HPs to be WMD's, and REALLLLLY scary dangerous if in a gun or not. Funny thing is, NJ politicians respect and coddle their gangs & the criminal element that preys on the disarmed citizenry .... something about professional courtesy. I always liked going to the beach in MD & NJ, even owned beach front property in Ocean City MD, which I sold. I had enough. Now going to the beach is like crossing the border into a country controlled by a 3rd world dictator. It is a shame, because I really like both these States. I also use to fossil hunt the creeks in the Freehold area, not anymore.

 

These anti-American nanny state governments like NJ, MD, CA, DC, IL, MASS, CONN, etc, with their unjustified feeling of superiority over their subjects, is very disturbing. This year the country is poised on the razors edge of turning this around, or becoming like the UK, Germany and Europe, forever. It's a shame that a large portion of voters are ok with that, and have proven it with their last 2 Presidential cycle votes.

In a State where people have their 2nd amendment rights intact, gangs KNOW they may be going up against an armed person. Before I retired I regularly went head to head against Bloods, murders and petty thugs in a ghetto city neighborhood, unarmed due to my companies policy of NO weapons. But the scum didn't know that. I always won, but was also listening for that shot out of an alleyway.
