SAF v NJ (MULLER et al v. MAENZA et al)

For a majority of the united states ccw is of no concern. Are we to believe that in nj there are more people with out common sense and or logic then any of the other states. That the chances of gun related accidents and crimes are more likely to happen here then any other state? Sure the anti gun politicians want people to believe that. Fact is if ccw happened tomorrow nothing would really change in sense of risk of safety for people in general.

 

At some point sure someone might make a bad choice and pull a gun when they shouldn't, someone might get accidentally shot.Bottom line the point of all laws and regulations is to create a positive outcome over the previous situation. If someone values their life and wanna do harm to others but have to worry about losing there life in the act they will think twice. I am sure the number of prevented crimes will drastically out weigh the accidents and mistakes that will occur. In legislation and law making that's considered a success. The outcome of the ccw law should not play any roll in other gun legislation.

But the thing with CCW is that when it passes give it a couple of months max and someone will do something stupid. You and I both know it. Many people will be carrying just for the "cool" factor. Then when someone goes to challenge the AWB, permits, ect the state legislators will say "we gave them CCW and look what happened." Thus pretty much shutting down any other chances of gun reform. CCW is going too big too fast, we need to show that if they change other smaller laws such as permits, we are a responsible enough group not to have anything happen and show by example that we are responsible enough to go after the larger issues.

 

I would hope that NJ gun owners are just as responsible as anyone else in a US CCW state. The libs in this state will fight against anything pro gun. It doesn't matter the cause. We are not children and don't deserve to be treated as such by our socialist state representatives. I say give us CCW and then fight them in court if they try to take it away. Anyone not following the law should be charged accordingly.

 

We have to get away from the liberal socialist thinking that this state has endured for years. This state is not like the rest of America. We don't need to prove anything - just give us our rights. I have the opposite opinion that we are moving too slow. We are one of the few states that don't have CCW. Why not? Do we really need our government to treat us like children? Are we really less responsible than TN or FL folks?

Who cares what the legislators say... all that matters is what the court thinks.

 

I was referring to anti-gun groups , and how they will try to continue to "reasonably regulate" firearms into pea-shooters.

it may be a day or two to see the text..but,how many ways can nj say "its for the collective safety" that the ccw scheme is constitutional...all they can hang thier hat on is what the macdonald/heller courts did'nt say as a way to justify thier interpetation

of the rulings and the scheme in place to prevent blood in the streets.....

wont the judge just get sick of extensions at a certain point? I mean isnt this a bad tactic?

 

You would think so, and it would be logical in theory, but it's the AG requesting it so that probably carry's a lot more weight than if is was the other side, aka The Right Side, the Peoples Side, the people who can think for them selves side and many more aliases.:icon_e_biggrin:

IIRC the only other extension filled thus far was for the last filing by the SAF. I believe everything else was on schedule. With that said based on their last filing I'm sure this one will be full of more tales of leprechauns, bogeymen, and pixie dust farting unicorns. If you asked the AG how firearms laws in NJ prevent violent crime I'm sure the simple answer is "magic".

I am wondering if it is a 'tactic' of somekind, or a fear and re-grouping to stave off these darn 'gun-nutz' as they would put it.

Don't think it is any kind of a tactic, in fact think it was expected because of the extension asked for by the SAF on their response which effectively gave the AG 2 fewer days for her response to meet the 3/9 deadline.

 

Think everyone is reading a little too much into this...

Agreed. Minor schedule adjustments are routinely granted, especially when the other side consents. And the other side almost always consents, it's a common courtesy.

 

There are a lot of reasons the AG could have asked for an extension, just like there are lots of reasons SAF asked for an extension.

I think paula left this case in her interns hands and they gave a crap response so now she asked for an extension so she can try to pick up the ball for a dismissal. Maybe with the three day extension the argument she submits might actually look like it came from an attorney.

A 3 day extension is hardly "excessive". If they asked for 3 weeks, it might be a different story.

 

This isn't school where if your report is late you have to "beg" the teacher for an extension. This is the real world where all sorts of things occur in life which could cause them to push a response to what they see as a frivolous lawsuit.

A friend of mine was at an NRA course today and said the instructor told the class that NJ is gonna allow CCW and is trying to figure out a new scheme. I asked my friend to ask him what were his sources and the guy just said trust him, CCW is coming REALLY soon.
