ESB 247 Posted April 12, 2022 Homeowner was charged with gun crimes because he had drugs (marijuana). https://www.pennlive.com/crime/2022/04/homeowner-charged-after-fatally-shooting-armed-robber-authorities-say.html
father-of-three 243 Posted April 12, 2022 "US Marshalls?" Interesting. I dont know all of the changes to CDS laws as they now relate to legalized marijuana, but the intent to dstribute a half pound of marijuana may be a factor.
45Doll 5,877 Posted April 12, 2022 The charges were not related to the shooting itself. Yet. Dillard is charged with possession of a firearm while engaged in drug activity, receiving stolen property, tampering with physical evidence and drug-related offenses, police said. Tunaman 552 Posted April 12, 2022 Even though it is legal in NJ, You cant have weed and guns because it is still illegal federally....which is about to change as the government has started the process to remove weed from the controlled substances list. When that happens there wont be jack shit they can do in NJ if you have some weed and a legal gun...as both will be legal. Until that time happens, off to jail you go. And you lose your firearms rights for life.

In this case the charge would be possession of a firearm while in possession of weed with the intent to distribute without a license

Legalization has tied law enforcement's hands except under certain circumstances, one of which i believe is a significantly large amount of marijuana. marlintag 223 Posted April 14, 2022 It appears in this particular case the homeowner was not the good guy, but rather a low level drug dealer who happened to own a gun. We don't know if the gun was legally owned or not. We do know the charges though: Dillard is charged with possession of a firearm while engaged in drug activity, receiving stolen property, tampering with physical evidence and drug-related offenses, police said. Even if he didn't have marijuana, he still may have been charged on "receiving stolen property" etc..
