Legal self defense ammo?

Hi,

 

Is Hornady Critcal Defense 9mm ammo 100% legal in NJ to use in home for self defense? I am looking to purchase some home defense 9mm ammo and since hollow point is out of the question, wondering what my next best LEGAL option would be?

You're kidding right? Hollow point ammo has more restrictions than non HP ammo in the PRNJ, but not in your home or at the range. Only in transportation.

I was told its just the opposite! Hollow point is legal to purchase, transport and shoot at range, BUT ILLEGAL to use in home for self defense.

It's illegal to use during the commission of a crime. That includes transport laws. If you are transporting your guns inappropriately, thus illegally, and have hollow points that becomes a crime.

Hum. i was specially told by my FFL, a recently retired LEO, that Hollow Points are 100% illegal to use in home for self defense and was told my alternative option is Hornady Critcal Defense 9mm, since its top is polymer filled and technically NOT hollow point.

 

He told me just the opposite of what you guys are saying! Its totally legal to purchase, transport and shoot at range, NOT legal for home defense! 

 

I dont get it!

Say you want to go to the range after work. You pile your rifles and a shotgun in the trunk with ammo. You can drive to work, stop to go shopping, whatever, you are good to go WITH a FPID card.

 

Throw any handgun OR a single hollow point bullet into the above scenario and you are now a Felon. Think of a handgun and a hollow point bullet as the same when transporting, you must take the most direct route, etc.

 

You would not drive around with a handgun on your passenger seat. You should also not drive around with a hollow point bullet in your ashtray. Even a stray .22.HP Both could get you in trouble!

It's an entirely separate discussion as to whether polymer tipped ammo like Critical Defense or Guard Dog are considered "hollow points" or not.  Some say yes, some say no.  If I'm not mistaken, state laws refer to "expanding ammunition."  In either case, as others have noted, hollow points are perfectly legal for home defense.

 

The takeaway here:  Don't take advice about firearms laws from LEO's (with the exception of the knowledgeable guys on these boards, of course).

Transportation and Use of Hollow Point Ammunition by Sportsmen

Provided certain conditions are met, a sportsman may transport and use hollow point ammunition. There are no restrictions preventing a sportsman from keeping such ammunition at his home.

N.J.S.A 2C:39-3f(1) limits the possession of hollow nose ammunition. However, there is a general exception that allows for the purchase of this ammunition but restricts the possession of it to specified locations. This exception provides that:

(2) Nothing is sub section f (1) shall be construed to prevent a person from keeping such ammunition at his dwelling, premises or other land owned or possessed by him, or from carrying such ammunition from the place of purchase to said dwelling or land . . . [
N.J.S.A
 26:39-3g (2)].

Thus a person may purchase this ammunition and keep it within the confines of his property. Sub section f (1) further exempts from the prohibited possession of hollow nose ammunition "persons engaged in activities pursuant to 
N.J.S.A
 2C:39-6f. . . ."

 26:39-3f. (1).

Activities contained in N.J.S.A 26:39-6f. can be broken down as follows:

  1. A member of a rifle or pistol club organized under rules of the National Board for the Promotion of Rifle Practice and which filed its charter with the State Police;
  2. A person engaged in hunting or target practice with a firearm legal for hunting in this State;
  3. A person going directly to a target range, and;
  4. A person going directly to an authorized place for "practice, match, target, trap or skeet shooting exhibitions."

Ok, you guys win. Just curious if you google "hollow points in nj" EVERY SINGLE page that come up says they are illegal! Even that YouTuber Hickok45 says "I feel sorry for NJ residents that hollow points are illegal". Guess EVERYONE is misinformed!

You broke the code!  NJ gun laws are backwards in many ways. Including the way they are written. In the PRNJ, everything is illegal unless exempted by statute. If it is not mentioned, like breathing air, it is not illegal!

What on earth would I EVER keep hollow point (or ANY bullets for that matter) in my ashtray??? When i go to range, ammo is securely stored in trunk, separate from my firearms and obviously NOT loaded!

I was simply trying to get you to equate a handgun and a hollow point bullet as the same thing. Both have the same restrictions for transport.  Non HP ammo does not apply.

Probably due to many intertwining interpretations and then the web does what it does. Takes opinions as a fact. 

Actually come to think of it your Sheriff friend may have not understood all hollow point aspects of same as Hickock.

So i take back that its good that he is retired. I wish him a Happy Retirement.

      The  12-1 compression ratio L88 is long gone. This is GM's updated version. it might be  pump gas 10-1 engine The L88 was a aluminum head  cast iron block engine with a nasty solid lifter cam. the  ZL1 was a all aluminum  12 or 13-1 compression ratio engine with the best forged internal parts at the time and had a even nastier solid lifter cam

      I like my regular carry holster.  OWB leather with belt slots.  I've been carrying for over a year and it was comfortable and I hardly even noticed it.  I carry (usually) a Ruger LCP .380 - light, convenient, tiny. But...today I ended up taking it off an leaving it home after a few hours. I cut down a big maple tree a few days ago and I spent 3/4 of today loading and unloading firewood into the back of my truck and a trailer.  It was a warm day, I was dirty, tired, sweaty, and my holster was rubbing against my side.  The leather and exposed metal snap was no longer comfortable. I'm thinking about adding a layer of something to that part of the holster to soften the contact.  Anything insulating will make it worse.  I don't want a sweaty, hotter holster against my skin.  I'm imagining something thin, breathable, that won't absorb sweat, and softer than leather, metal snaps, and rivets.   But I have no idea what would work. I'm hoping somebody else has already figured this out and I can just do what they did. Any suggestions appreciated.

      Check the primers on the ammo you didn't shoot yet. Are they fully seated? If the primer is not just below flush with the back of the case, the first hit can seat it better then the second hit ignites it.
