Well Nappen makes his living terrorizing people with talks and books so......

@FreeNJ your overthinking this. Ship them out if you want to get them out of NJ. Many people shop illegal items in the mail every day and rarely anyone gets caught. However I'd recommend keeping them, keeping your mouth shut and joining a range in PA such as EFGA and use them on a regular basis. When I was a member of EFGA I met many NJ residents with 30 round mags in their ARs and AKs. No one is coming to raid all NJ gun owners homes looking for mags on the 10th. Hell I know of at least one town who have signed a pledge that they will not enforce any new unconstitutional gun laws (this was right before the presidential election) they presented it to the chief who then signed it and sent it to the DA. Their feelings have not changed.

I feel like many in our community here have willingly taken a pair of scissors and severed their own testicles. "Turn in your 15 rounders." Yes sir! I don't want any trouble. "Turn in your AR15s." Okay fine. I really don't want any trouble. "Turn in your handguns." Oh well. I want to stay out of trouble. "Turn in your shotguns." Ummm, I had enough! Too late asshole, your unarmed.

Over the past few weeks we have seen an increase in the amounts of new shooters visiting the forum, asking questions in anticipation of the December 10th deadline. On one hand, I don't believe when it comes to gun safety and legality there are stupid questions... such as the topic here... The new gun law and transporting magazines started by @FreeNJ, a new forum member. And yes... without a doubt... hundreds of thousands of NJ gun owners are going to be criminals on Monday.... But... are our own 2A "leaders" for the lack of a better word in NJ going a bit overboard with fear mongering? We talked about this in chat today... and if you have not, you should check out the NJGF Chat. One thing I mentioned was the daily messages from ANJRPC counting down the days until the mag ban... yes, I know.. Monday... do we need a daily message discussing it and of course a daily plug for a business that will hold those mags for you for a fee per magazine? (after 12 months of which you are better off just buying new mags). Again, don't have too many issues. And then I went on facebook and found this gem... My response to that is... So what do you think? Overboard? Or are the black helicopters going door to door for Christmas? (Too late for Chanukah, tomorrow is the last day). (Btw.. just don't blame the mag ban on the Jews... or Putin... I beg of you.)

Problem is people think what he says is gospel and the only opinion that counts. I’ve had mine written off several times despite my experience, only to have some one say nappen says x, y, or z and everyone immediately believe it, even when wrong. We can lead them to water...

So I guess everyone with a Beretta 92, Sig 226, or any other pistol with an OEM 16+ round mag has already been contacted under the old 15 round limit? Funny, I never heard anything about that.
  7. 4 points
Here is your last chance. Take your 11+ round magazines and mail them (UPS or FedEx too) to prominent Democrats and other Anti Gun jerks. Then drop a dime to the state police reporting these people as being felons in possession of illegal objects. Remember all they have to do is have them, they don't even have to have a gun. This will solve many problems.

...."Look for the same approach in New Jersey. Neither Governor Phil Murphy or AG Grewal has any interest in going door-to-door looking for 15-round magazines. And when the State Police’s Lt. Schafer says, “We will enforce the law of the state,” that means they’ll charge you if they happen find +10-round magazines in your car during a traffic stop. Or if someone breaks into your home and they happen to see an offending magazine when they investigate. So look for New Jersey’s gun owners to respond to their state’s latest Second Amendment infringement much as New Yorkers did. By flipping an invisible bird at the Governor and legislature and claiming all of their standard capacity magazines had been lost in an unfortunate series of tragic boating accidents.

This is just stupid. I've had guns for years that were capable of accepting mags of greater than 15rds and nobody ever came knocking.
  11. 3 points
everyone make sure you pop off 11 in a row. 10 in the mag, 1 in the chamber.

Nappen is useless to the law abiding citizen. He would not like any gun laws to be laxed . The stricter the law the more money he makes. I would not buy any of his books or read his advise. A few years back I applied for a CCW in Jersey. The State Police approved me but judge Pereksta denied my case and wanted exact dates when "immediate need"occured. I asked Nappen if he can represent me and he told me his fees start at 8K What a crook. He is not your friend but pretends to be. I understand he needs to make a living but not by exorbitant fees. Nobody is going to ask you about your old mag. Nobody is going to call you.

You know, I think we spent so much time over thinking this that we missed the obvious. If we found a trusted illegal alien in NJ to hold them all for us they'd be safe. Even if they were found there they'd be forgiven. And we'd all owe Murphy thanks for the free storage facility.
  14. 3 points
Nappen's scenario will not happen. Owning a gun that accepts a >10 Rd magazine is not probable cause for a warrant. Otherwise all of us who own ARs, Mini 14s, and other long guns could be subject to having a search warrant issued because we may have purchased a 20 or 30 Rd magazine in another state. I solved my magazine issue for ARs long ago when the Federal AWB expired. Suppliers were dumping quality 10 Rd magazines for as little as $5 each. The few 15rd AR magazines I had have been disposed of. I did the same with 10 Rd magazines for handguns. Reloading is a valuable training point on the range and 10 Rd magazines make you do it more often. My >10 Rd handgun magazines have been properly taken care of. Saying possession of a >10 Rd capable handgun is less than probable cause for being drunk in your living room, having your car in the driveway, and being arrested for drunk driving. Now drunk driving is the only mv violation you can be arrested for on private property. If I'm wrong any current LEO please correct me. If you're drunk and move your car in your driveway you could be arrested. I have never been a fan of Nappen. I've never seen him win any big cases. If I'm wrong someone please tell me. Nappen is a fearmonger. He is the type of lawyer that if asked "what should I do" he responds with "do nothing". IANAL but I've dealt with a lot of lawyers in my adult life. As prosecutors and defense attorneys. It wouldn't surprise me if Nappen said "don't have any guns and I'll guarantee you won't have any gun problems". He is a grandstander. There is no plan to enforce the 10 Rd magazine law in NJ because it's a "feel good" law just like the AWB. The >10 Rd magazine law will be enforced like the >15 Rd magazine law.

From wiki: Broadly speaking, a risk assessment is the combined effort of 1. identifying and analyzing potential (future) events that may negatively impact individuals, assets, and/or the environment (i.e., risk analysis); and 2. making judgments "on the tolerability of the risk on the basis of a risk analysis" while considering influencing factors (i.e., risk evaluation).[1][2] Put in simpler terms, a risk assessment analyzes what can go wrong, how likely it is to happen, what the potential consequences are, and how tolerable the identified risk is.[ ...So, yes, the probability of getting caught is extremely low, but the penalty is extremely high. And if one is caught, the state may want to make an example of you. Money is one thing, but how tolerant are you and your family to jail time. For what 500$ or so worth of magazine, is it worth taking this risk, everyone can choose, but not something I would take on (If they come for our AR's, etc., in the years to come, that would be a different assessment, for a different time)...And lets be honest, hope I am wrong, but I doubt the Supreme's are going to take this case, and the likelihood of ever using these mags again (unless you move out) is very low. Ship them to a relative OOS or something (one that doesn't charge you 1.25$/month/mag-LOL!) eliminate the risk all together but still have a way to get them back in the small chance the law is overturned.

While I agree with you Maksim, the daily ad's in the e-mail are very distasteful. But we need to keep this in perspective, overall it is a small matter, and ANJRPC, which so many of us have donated to for the two lawsuits this year, is doing all of us a great service. With the amazing fact that our fellow citizen's, gun owners or not, allowed Murphy to get in, with the amazing fact how inept the Republican Party has been at the federal level to help those in lefty states, ANJRPC is all we got. They are doing 95% good stuff, I can tolerate the 5% which misses the mark some.

Lt Schafer is in the Public Information Bureau... he is answering a question, and isn’t really giving the 411 on that policy. I do know Lt Schafer (very good guy)... and he likely would research something if he knew he would be answering specific questions on a topic, but what else would you expect him to say in regards to that? “It isn’t conceivable to enforce this law, so have fun!” That’s like asking if they are going to pull every single person doing 66 and above on the Parkway over... would they say “yes” or that they will enforce the speed limit law of NJ? That was a very safe answer to give. Sorry, but while the author put together an interesting article, it really doesn’t stand by itself. Putting “Lt Schafer from the NJSP” sounds like he is getting info from the Firearms Unit. Just because they (NJSP and AG) didn’t say how they are going to enforce the law doesn’t necessarily mean they aren’t doing X, Y, or Z. That being said, I do doubt you are going to see Troopers going door to door, confiscating magazines. A better person to interview about it would be Grewal or Murphy... but they wouldn’t answer those question directly (they know the truth).

I think in this situation there are going to be several layers of reasonable before you actually ended up in prison... so IF you made the effort to modify them to 10.. like if you actually did it.. I would be surprised if you ended up in prison.. even if it wasn't really permanent... first the LEO would have to think that the modification was not enough to be permanent.. I actually think this is where it would stop for more people.. I don't think a cop who comes across a mag.. that only holds 10 rounds is going to spend a whole lot of effort determining if its "permanent" enough.. unless of course someone is giving said cop a reason to try to find some way to bring you in.. if the mag only holds 10.. I think the cop would walk away.. then you will have more layers.. does the prosecutor even think its a reasonable case to run with? will a judge find your effort of permanency reasonable? there are a lot of people that need to come to the conclusion that you did not reasonably comply with the law.. and I find that unlikely.. lastly... IF someone made the effort to comply... and was still being charged.. and could find a good lawyer.. I think it would actually be GOOD for the cause... it would illustrate the unreasonable burden put onto normal lawful people by this law..

I agree with both statements above. And as distasteful as it is I believe one of the emails stated a portion of the storage fees were donated back to ANJRPC. A little dancing with the devil but funding is funding. And yes, if they take my stuff in an illegal search and seizure I’ll buy even more after my civil rights settlement is awarded.

You know... Murphy would likely consider an unloaded magazine "hazardous"... and speaking of unloaded magazines... I have a letter from TSA somewhere when I forgot to take out some unloaded mags while flying out to USPSA nationals in Vegas. PHL cops that were called thought it was funny and stupid (unloaded mags), the TSA lady... not so much.

OK, what's with the Fashionista talk? Sheesh! You boys are starting to worry me... though I LOVE the pic above. Adore him! AND his snappy suit. Back to the topic at hand... their interior minister just reported there were 125,000 protestors across the country, 10,000 in Paris alone. Yikes! That's only a scant percentage of their population, of course (at 65+ M), but still, it's enough people to cause a massive amount of damage to buildings, cars, stores. Worse yet, they've had to shut down tourist attractions, shops, etc. - all during the lead-up to Christmas. Even if they manage to get through this with Macron still in office, my god, they will have taken a financial bath the last several weeks.

I don't think having anything sealed in a package ready to be mailed would protect you if the police had a search warrant. A warrant specifies the items that are being searched for. Police can look anywhere these items could be. If they could fit in a sealed package in a residence the police could search there. If a sealed package would be exempt from a search criminals would have been doing that for years. I retired after 30 years as a 1811/Criminal Investigator for a federal agency. Local police who want to search a package in the custody of the Post Office aren't going to get anywhere unless they get the Postal Inspectors involved. If there is a federal crime involved they will be the ones to get the warrant. The only exception is if the package is entering or leaving the country then CBP or HSI can search it without a warrant. Local police do not go to a federal judge for a warrant unless they are on a federal task force like JTTF or a DEA drug task force and are cross designated as federal officers (TFOs). If a federal officer or TFO is looking for a warrant they need to go to an Asst US Attorney first where it usually gets written up. It needs to be for a federal crime. The federal system has no interest in enforcing state law (although they could do so if they wanted to). Then it goes to a federal judge. On weekends I have gone to vacation homes, boats, golf courses, parties, weddings, and other events to get the duty federal magistrate to sign the warrant. I also think people are over thinking this. The only thing the post office ever asked me is if there was anything hazardous or liquid in the package. The only problem I can see is if you take Nappen''s advice and claim "books and magazines" and take the lower (4th class?) rate for printed material. I'm sure there's some kind of fine for that.

Thanks for joining the forum and asking your question. I am sure many who read it will have similar questions. I think to help, you need to look at it more broadly. From the straight up legal perspective, I do not know whether a sealed package is fine or not, BUT as another member mentioned, there are 24/7 USPS kiosks or just drop it off in the post office box. Generally, as long as you do, you are fine. Alternative is, since it is the weekend, mail it USPS. You can print label and drop it off OR just take it in a box to Staples. They will give you a dropped off receipt showing Sunday. Now... having said that, A LARGE percentage of the active posters have been here for more than 5 to 8 years, quite a few are approaching 10 years, and many if not most have shot for longer than that. Over the last 10 years, particularly under Murphy, gun owners have been under constant attacks. Today, I would venture most just don't a crap anymore about the 10 round mag limits and during the last few months you likely had MANY boating accidents with everything lost in the water. (not literally but you get the hint). Is it breaking the law? Sure... but so is speeding. The odds of the police busting down your doors on Monday looking for 15 round mags is close to zero. You do have to know though that IF you happen to do something else stupid and the police have to come down to your house or just happen to pull you over, smell drugs and decide to search your car... yeah... you will get charged. Once you realize the difference between a 10 round mag and a 15 round mag is either a different spring, a rivet, or a piece of wood inside, the hole notion of low capacity magazines saving lives is a joke. Welcome to the community. Edit: This is not legal advice, nor do I live in that forsaken state anymore... (although I can still smell the air and buy my gas there). @SJG

My wife insists we don't keep any of our guns in the bedroom. I think one handgun would be sufficient. Now that she wants to get a second handgun for herself (She's thinking about a Sig P320 in .45), I was like great, that'd be fantastic for self-defense.She said no to that so I said fine, I'll keep my .22 in there. She said a .22 would be pointless and that her 9mm would be much better. Checkmate, already got her thinking about what we SHOULD have in there, not whether we should. I don't give a crap if it's my .22 or if we get a .50 cal. Most people aren't wearing body armor and the shrapnel from the .22 will still accomplish plenty. This story just re-enforces my opinion that we should have something ready for self-defense.

France seems to be going through step 8 of the Saul Alinsky plan: 1. Healthcare. 2. Poverty 3. Debt 4. Gun Control 5. Welfare 6. Education 7. Religion 8. Class Warfare Obamacare, increasing numbers on food stamps by over 60%, doubling the national debt in 8 years, all you people holding on to "your guns and Bibles", standardized education, and working to divide classes of people were just a few things Obama did. Socialism is not your friend.

This^^^^^ Where are they getting their numbers? An all-encompassing database violates federal law and anything less is only partial and thus inaccurate. Maybe from NICS requests - but that does not mean a firearm was purchased. Polls? Who of you out there would answer a random pollster as to whether you owned guns? Plus, they can't poll everybody, meaning there would have to be extrapolation. This is all BS. Adios, Pizza Bob

The grace period was 180 days, and the 10th is day 180, so my opinion is that you're good until 11:59PM on the 10th. On the 11th, at 12:01 AM, you're a felon. Amazing what one day makes....

Just so LEO knows, I've taken all my high-capacity revolvers and restricted them to either 6 or 8 rounds. Hope that you're happy Murphy. Seriously though, contrary to popular belief, I do own a fair number of bottom-feeders,and an AR or two, also. I spent about three hours on Thursday combing the house for any mags >10 rounds, and then bagging and tagging them. They all now reside, happily, with my son in PA. I then placed an order for some compliant mags for those guns for which I didn't already have some on hand. I really have a problem with wrapping my mind around making a law that applies retroactively. How we are made felons by the mere stroke of a pen, based on goods that were 100% legal when purchased, and worse yet - still legal in the majority of locales in this country. It really galls me to be able to walk out of my house with items that could put me in jail, walk less than 3/4 of a mile and be legal again. Here's hoping that the Supreme Court rectifies this injustice. I'd wish for the liberals to get their collective heads out of their a$$es, but that doesn't seem very likely - they're too busy trying to appear to be "doing something" even though it has zero impact on the problem. Rant off. Adios, Pizza Bob
